andy

Can anyone help, I keep getting money deducted from my Capitol One card by someone I stupidly signed up with. I need to cancell this but Capital one say that I can't do this. Is this true? If it is how do I stop paying these people ?

Thanks.

  • Hi andy,

As far as I'm aware it's only the other person who can cancel the payment and not you or Capital One. Another option would be to cancel this card, say you've lost it or something and then they will issue you with a new one. That will stop the payments. Other mse's please confirm this if you can?

Only the company taking the money can cancel the transactions and you need to get on to them to find out why they are still taking it.

If you have cancelled a contract but they are still taking money, maybe you could try to persuade Capitol One that they are unauthorised transactions.

This came up here before and it was only when it was posted, that many people discovered (myself included) that making regular payments by credit card or debit card can only be stopped by those taking the money, not the customer.

It's called a Continuous Payment Authority, or CPA. For further information, see the "Regular Payments off a Credit Card Discussion" thread...

  • Others have said on this site that even if you cancel your account a CPA can still be honoured and you can still get bills.

Report your card lost (NOT stolen) say you had it yesterday and think you must have dropped it whilst out. They issue a new card with a new account number (takes about 7 - 10 days) and all transactions against the old account number will fail. Obviously you should check all legitimate purchases have gone through first. Also make sure the company you are in dispute with has been told you wish to cancel the agreement you have with them (don't tell them you are changing CC account numbers). If you don't tell them and you signed an agreement you might still be liable.

  • If you read the thread posted above you can see that it is not always true that cancelling a card number stops CPAs. One person had the AA take money out of a credit card account he had cancelled four years earlier!

Surely if the card is cancelled (not the account) and a new card is issued with a different account number then the continous payment authority can't be taken as the details have changed? Please correct me if I'm wrong?

That is what I would have thought too - but others on this board seem to give stories of the opposite (although there do seem to be people who would back it up).

Perhaps it depends on the card company, type, CPA, etc. - I would really like somebody who is in the know (like Martin) to clear this up.

Capital Ones system links your old card number and your new card number so they can trace you and apply payments/debits to your account.

I don't think it will work.

I used to work for a bank and customers would ask for their full current accounts closing just because they could not get through to AOL to cancel their internet subscriptions that were made using CPA on a Visa Debit card.

  • I had this problem, one of the approved insurace company that takes payment out of capital one cards called me late at night :( you know what its like agree to it etc etc, I cancelled it just in time before they took the first payment (two months free or something) but as other posters have said its the other company not capital one that can cancel it.
