    Tink,

You don't need a reason to ask for it - THEY have a LEGAL DUTY to provide it! They also have a legal duty to supply it within a specific timeframe, and if they cannot produce one they are sunk. This may well be why they are trying to talk you out of asking for a CCA and just take their (usually lying) word that they have one!

You should definitely stop calling them, it is upsetting you too much, and you should also request that they stop calling you and deal with you by letter only. There is a template letter you can use for this - unfortunately I don't have it, so hopefully someone else will post it up for you. :) Send it by registered post (DON'T SIGN IT - print your name only), and if they call you after you have made the request they are breaking the law.

There is also a template letter and procedure for requesting a copy of the CCA - again, anyone got this? If they don't supply one within the required timeframe, then there is another template letter for the next step of the process too. :)

Now, take a few deep breaths - these people should be shot, but they CAN be handled. And we'll help you to do it. :)

    ~Jes :)

Do I do this through the debt company? not barclays?

You make the request to whoever is trying to collect the debt.

Some debt collectors lie and tell you that they don't have to comply, and tell you to contact the original creditor. But that is wrong.

I think I may tell them not to call. Some can be very nice and understanding but some will talk to you like dirt, I had one that started shouting at me! then she hung up! I was totally gob smacked. I get myself angry and then becasue I'm so angry I get upset

    Hi, Tink,

What these companies say and what they actually do are usually two completely different things. If you want the request to be regarded as formal for legal reasons, you still need to send the template letter. Otherwise they are likely to claim you never asked...

Remember, the key phrase to remember when dealing with this kind of company is 'greedy, lying scumbag bullies,' so NEVER give them the benefit of the doubt ;)

Once you have told them to deal with you only by post, the MOMENT they call again send the formal letter about only dealing with you in letter form. Just asking them may not work, unfortunately, for the reasons given above!

    Hang in there! :)

Shall I just put at the end of the CCA request letter that I want to l only deal with them in writting? I feel guilty as I'm not in a really awful mood and it's not fair on my family!!

I suppose you could do. Not really my specialist subject, though - you'd probably be better off sending the proper formal template letter about only dealing in writing to be on the safe side. That way they can't claim they didn't notice.

And, hey - it's understandable to be upset! These are not nice people to deal with. However, I know of one guy who dealt with one of these companys in very funny fashion, and I think you could do with a laugh, so have a read of this:

    Having Fun With Debitas

Wouldn't try this yourself, as this guy was being chased without reason, but it had me crying with laughter the first time I read it! :rotfl:
