Phone Call from Debt Collector

I received a call this morning from a debt collector chasing up an outsatnding loan I took from Barclays in 2003. It's around £9006. I went through phases of paying bits here and there where I could and then defaulted but heard nothing so, as a lot of people do, I burried my head and hoped it would go away.. Obviously it hasn't....

It did show on a recent credit report but I didnt know who was dealing with it due to it being old and passed around.

I explained Im a single parent with no income right now as Im a ful time student. She said she would make a not of it and send a letter, when I got the letter to call them back to arrange settling the outstanding.

Am I going to be paying small amount every month for the rest of my life??? what can they make me pay??

    I would start with the CCA request, in the hope that the legal paperwork is missing.

    Unfortunately, if you have paid dribs and drabs, it is unlikely that the debt will become statute barred.

    And if you do have to pay, in time, you may be able to doa full and final offer.

    It's a credit agreement which they have to prove that you have signed in order to chase the debt.

    How do I go about doing this?? it was with Barclays, nearly 6 years ago now

    Hi Tink,

    First off, don't panic. There are some template letters floating around you can use in this situation, and I'm sure someone who knows where they are and which ones to use will be along soon. :) This includes one for requesting the Credit Agreement, so that will be sorted.

    One point to note - when you write to them, DON'T sign the letter, print your name only. Some of these companies have been known to fake signatures in order to get their mitts on your money... :mad:

    Personally I wouldn't call them either, that just costs you money and causes you stress if they try to bully you. There is also a form letter for asking communication to be in writing only; again, I'm sure someone can find that for you. :)

    Thank you!! Im not keen on talking to them and it can be a really inappropriate at times! the lady today seemed really nice but I have had horrific experiences with some, often left me in tears

    Well I just asked for it. She kept telling me I need a reason to ask for it, and that 'because I want a copy' was not a reason :mad: she siad they will request it from Barclay's so it looks like they will be producing a copy.

    And just to kick me while I'm down, another debt collector has contacted me with an apparently outstanding water bill of £626 which seems a lot, for a prev addess. I'm a bit worried about this one..

    I was paying my debts and got an experien report that only showed the Barclays debt and one other I'm paying off. I find it worrying that they creep out the woodwork. I'm doing my best to sort this all out but its just like I'm taking one step forward and two backwards. I have 20 mins to stop crying, sort my make-up and get to college :cry: chin up eh

    They are talking absolute rubbish.

    You do need to make the request formally though.

    Link: Factsheet | Getting a copy of your credit agreement, account details and a statement of account.
    You must send the fee of £1 with the letter. If your creditor does not send you a copy of your agreement, or statement of account, within 12 working days, then they are not allowed to take further action against you to enforce the agreement until they do so.

    That doesn't apply to utility debts like your water bill though. But they must still provide proof that the debt is yours and how it is made up if you ask. ;)
