hi guys thought i would update...
the tenants deposit has been into a protection scheme, section 21 and 8 have been issued and all certificates are definately upto date.
she still hasnt paid (now 10 weeks in arrears and now owes £1800)and has now asked for an extention to the lease. As it is, the 2 months notice that I believe hubby has to give her takes her up to the date she wanted to extend to anyway.##
any further information/advise appreciated!!;)0 -

I'd start looking into small claims court procedure to get the £1800 back, although if they don't have any money, they might be ordered to pay it back at say £10 a month!!!
Keep writing to the tenant (recorded delivery) stating how much money they owe (keep it polite), and that if they do not pay it by the last day of the tenancy, then you will instantly start court proceedings to claim the money back. Point out that it will damage their credit file, they'll have a tough time renting another property or ever borrowing money again due to this, and they'll also have to pay the court costs.
You might have to take this as a learning experience, and in future take a larger deposit from the tenant, and check they earn enough money to pay their rent!!

You can't do anything to get her out until the appropriate notice expires. Then if she is still there, you need to spend more money in court evicting her.
With regards the £1800 currently owed, hopefully you have over £700 of that as a deposit. (Hopefully you didn't secure it with the scheme that automatically gives it back to the tenant at the end of the tenancy due to it's tardy protection)
Whether it's worth chasing the remainder depends on whether you think she can pay it. You might just want to ensure she has a CCJ on file that will make it difficult to find alternative private rental, as well as cause significant issues on anything credit related."Now to trolling as a concept. .... Unfortunately, hubby only took £250 as a deposit even though the rent was £600 pm. The tenant was found through a "friend" thats why he never took a deposit for 6 weeks. ( more fool him now!!)

Has you hubby ever done an inspection on the property since the tenant moved in?
If not I would arrange one this week, ensure that everything on the inventory is OK and general condition of the flat.
If the tenants came through a 'friend' will that friend be able to keep in touch with tenants as and wehen they become ex-tenants?0 -

you need to wait for the periods on the notices to expire.
IF you have served them correctly, & she owes so much, the quickest route is via the section 8. You can start court action 14 days after you served this. Did you attach a schedule of arrears to the section 8? For the section 21 you need to wait until 2 months after you served it. Have you read the attached info on the notices you served?0 -
Sadly good tenants are almost as rare as rocking horse muck. The very reason why many people rent is because they have issues. Inexperienced BTL'rs are lambs to the slaughter with some of these people. they know the score.

Actually, many of my tenants can easily afford to buy, but choose not to, as they want the freedom & flexibility of renting over homeownership. I am the one fretting about getting out plumbers, bills etc, & they seem to spend a lot more time on holiday than I do0 -

I rented for 18 months before buying as I hadn't lived in the town before so wanted to make sure I liked the area.
Not a single person I know who has rented has or had issues, or caused trouble for their LL.
