Advice with dla

hello im after some advice for claming dla iv read lots of horror storys about people that sound relly ill and get turnd down. isit really that hard i dont evern no if its worth me applying what do you think?

i was in a car crash 5 years ago which crushed my left leg which had to be rebuilt and has been left still in a bad way. this is all backed up by doctors records i had 3 operations to sort it.

basicaly i cant walk one step without being in bad pain i cant put weight on my leg full stop neither can i bend my knee. im constantly in some sort of pain.

i really dont understand dla or how it works if i cant walk one step without been in pain would i qualify?

    Basically DLA is made up of 2 qualifying parts.

    Care component, do you need anyone to supervise you at any point in the day.

    Mobility, being unable to walk - this basically means literally cannot walk at all but there is also a stipulation of being 'virtually unable to walk' which is terribly ambiguous as there is actually no definitive measurement of if someone is 'virtually unable to walk'.

    Probably be an idea to consult your doctor.
  • i see my gp every 3 months for presciptions pain killers and i last saw my doctor just over a year ago where i had my last operation. there is nothing more that can be done other than pain killers now.

    what do i need to claim do i need reports from my gp or doctor? my doctor is a specialist and it takes around 5 months to get an apoinment unless its an emergency im sure my gp will be happy to do a report but isit a must or do you just fill in some forms?

    does anyone on here get dla for just been unable to walk due to leg pain?
  • i havent worked for a year and i also havent claimed benifiits i have visted my gp every few months do i need to acutaly have been signd off sick by my gp for 3months before i can apply for dla? or isiti have to have had the problem for 3 months? i have had the problem for afew years.

    You don't need to be signed off work sick or on other benefits to get DLA (certainly not the mobility side of things).

    All I can say is that my brother-in-law gets this, following a road accident in which he was knocked off his motorbike. It took them months to "repair" his leg, and he can now manage short (by my standards, as I don't have problems) distances using a stick -- but as soon as the wind gets up he can't walk around outside as he gets blown over.

    He did have to appeal when his first application was turned down though, and I know he applied more or less as soon as he got out of hospital.

  • I would strongly suggest going to CAB to get them to help you fill these forms in my husband has two permanent disabilities and failed to get any DLA after 13 months of us trying, we are about to apply again with a new claim and this time we are going straight to CAB we had an appointment yesterday with a lady at the job centre who's own father has one of the disease's my husband has and she said he gets DLA but the amount of people she knows that are genuinely really ill and don't get it is unbelievable.

    I've heard all the stories to about filling the forms in but i can't get out to CAB for there help so i just went a head and did them myself sent them off and had a phone call just for a little more information and it took around 4 days for the phone call and about 2 weeks to hear back!
    I recieved a letter stating i had been awarded lower mobility rate great news for me!!

    Its up to you CAB are good thou!

    It is true you can get it by filling the forms in yourself the people that say you can't are wrong, we did have help with DLA but not the form filling we did that before we went for help and we failed but this time we will use them to help with the forms, i guess it just depends on the decision maker you get on the day, if 50% (or there abouts) of claims fail it can't just be how the forms are filled in in all those cases surely. Congrats on getting it though Kategregory.
  • thank you everyone there is a lot of usefull information about im glad i have researched a little bit, i did plan to just get the forms and fill them in but i would have worded everything completly wrong im going to spend a few days researching and decide weather ill get help fillinf them in.

    one thing i have read a few times regarding care is that evern if your not currently getting care doing ceartain things and you are just managing on your own you are still entiled to care because having help with thoose activites would make it easyer for you is this true?

    for example i dont get any help using the toilet its something too personal i would rarther strugle on my own than get help doing! for me i can not just sit straight down i have to hold onto something with my arms to east me down if you know what i mean with the toilet i have lean my hand on the wall and easy my self down. is that something worthy of care? i dont have a hand rail by the toilet can they use this against me and sayi should have one fitted and that would solve my problem?

    Hi they could say that a hand rail would help you but if you feel it wouldn't then explain these kind of things (i.e why it would not help, i would still need help doing this..).

    The recommendations they make have to be realistic, if somebody is prone to falls or passing out telling them to sit on a stool in front of a cooker isn't really realistic as they could still fall onto the cooker etc.

    There are a lot of guides online which help to fill the forms in but from my own experience with it i would never attempt them alone without professional advice again. Good luck!

    Yes what you have said is correct, it is the care that people "need" rather than the care that they actually "receive". That is why there are many people who live alone with no help who still receive DLA. As has been said with DLA forms it is best to get professional help to fill them in.
