Pipex (Tiscalli) Did not disconnect my old BB connection

Hi Guys,

I have been with Pipex for the last couple of years and by and large have had little problem, that it is until I moved back in March of this year.

When I moved to my new address Pipex told me I would need to terminate my current contract and start a new contract under the new address which is what I did. Pipex told me that as a loyalty bonus they would give me a free wireless router and free reconnection. However it turns out that a month or so later they charged me £69 for the pleasure. Then I find out that they were still charging me for my old address on my previous account as well as charging me for my new account at my current address. Despite phoning them several times and explaining the situation and the customer services assuring me they would get back to me I still have not heard a thing.

The customer services were friendly enough but as they are based in a different country there was a language barrier and their grasp of English was not the best in the World through no fault of their own of course.

Then I receive a letter from a debt collection agency who are working on the behalf of Tiscalli (Pipex) and are trying to claim the £40 odd pounds owing for the previous account as I cancelled the Direct Debit as there was no way in hell that I was going to pay for a connection at a address I was no longer living at. I spoke to the debt agency and told them not only am I not paying them the money on their letter I would be taking legal action myself to reclaim the monies taken from my account form the previous account as well as the £69 for the wireless router which they promised as free and I have an email to prove that.

What I wanted to know really is this. What would I need to do in order to recover the overcharge and router fee from Pipex? Would I take them to a small claims court and should I report them to the OFT?

I am going to write to Pipex and tell them to terminate my account as they renaiged on their promise of a free router and lured me back as a customer under false pretences in my opinion. If I knew they were going to be this much bother I would have gone to BT for my BB internet.

Thanks in advance for any help offered.
Kind regards,

Michael

  • First of all start doing everything in writing. Keep a note of dates (chronology would be useful) then find out the name of the managing director of the company and write to him/her directly.
  • I would definately leave the Small Claims Court for a last ditch effort. As has been said, do everything in writing where possible, and send all letters by recorded delivery, and always get a receipt. Report them to OFT and OFCOM. Phone them as well, and try to get your money back. They should record all phone calls to customer services anyway(standard practice these days) so they can't say you said something you didn't, because you/the court can just ask them to prove it, which they wouldn't be able to.

    Good luck, mate.
    Neurotic since always...
  • Thanks to both of you for your comments and help, I really appreciate the help. I have now been threatened by Debt Collector who are acting on behalf of Pipex stating they will be paying a doorstop visit to recover the debt within 7 days. Should I just pay them and then try to recover the debt?

Thanks in advance for any advice given. :)
    Kind regards,

    Michael
