I've done my own DMP and the majority of creditors have accepted my offers. However I'm having problems with Littlewoods. I owe them £496.08 and have offered them £1.94 per month. I have been sending them this for the last three months. They will not accept it. They've said that the minmum payment the company would be able to accept is 6 instalments of £34.
They have said they "respectfully suggest you contact a debt management company such as the CCCS. Once they are dealing with your finances we can re-assess your offer of payment. ... You will need to request that they contact our Debt Management Team to renegotiate a payment plan for you and to also request that we hold all admin and interest charges being applied to your account ... I appreciate that you have already completed a budge sheet showing your income and expenditures, however, this information does need to be provided to our Debt Management Team from a debt management company to ensure that the information is accurate and up to date ... I must advise that if you do not act as suggested then your account will follow our normal debt recovery process."
I'm at a loss as to what to do next. I don't really need to get CCCS to do a DMP for me as most of my creditors have accepted. Can you tell me what their debt recovery process is likely to be? Can you tell me what is likely to happen if it went to court?

It is good to hear that the majority of your creditors have accepted your payments.
With regards to Littlewoods, I would continue making a payment that you can realistically afford and do not be pressured into paying more.
If they are not happy with the payment and wanted to take further action, they would have to send you a default notice. This is a legal requirement they have to do before they can take any further action.
If they pass you onto a collection agency, you need to send the collection agency a copy of your budget and an offer of payment and, again, you must not be pressured into paying more than you could afford.
If you get a County court claim form,then fill it in and return it as soon as possible (within 14 days) will a copy of your budget and offer of payment.
The judge then decides whether your offer is a realistic one or not.
A CCJ would then show on your credit reference file. As long as you maintain regular payments, the bailiffs would not be involved.
If you wanted to make an appointment so that we could look at your income and expenditure and put together a budget for you as requested by Littlewoods, then you can call our free helpline on 0800 138 1111. They may then agree to considering stopping the interest and charges although this can never be guaranteed.
You would be under no obligation to do a plan with ourselves and you could continue to make your own payments.

At least now you are dealing with your situation and I am sure your hubbie has made a very good choice of wife!
It is good you have told him about your situation and you are not trying to cope with all this on your own.
With regards to your joint bank account, if you have no debts there at all, then there is no reason why you should change.
However, it is important that you do not use the overdraft.
As the debts are all in your name only, then there is no reason why they should impact on your husband.

I've got 2 ccj's registered against me and i am paying the agreed amount. I have been told i'm at risk of redundancy. I wanted to start researching my options now. I will beclaiming JSA if laid off. how does this affect the ccjs and would there be any impact (of ccjs) on redundancy payout?

Hi please can u advise what happens whn u have completed an IVA what happens after 6 years is your credit file clean? I am hoping to enter into one but dont want to be stuck with the same mortgage comapany forever would I be in a position to apply to other lenders. Is there any trace of iva on the file i.e does it leave a footprint or is this just a myth?
I noticed someone on here saying thy had completed and had just got a visa card to start building rating again but one of these rip off rate ones. Would this matter if u already had a mortgagae payment and other things on direct debt throughout the iva as u would have showed u r making regular paymenets on these. Does this help?

Hi sorry I also have another question at one point will a creditor issue a default notice or can they do this at anytime? If I make token payment for two months and then thy get passed to debt collection agency and I make an arrangement with them can thy then isue default?
Also can debt collection agency continue to add interest to the amount or is this not allowed?0 -

Hi,
I am a joint 1/4 shareholder in a small enginnering company.
I have personal debts off approximately £33500
This debt was more than manageable when things where good, however as everyone knows things aint so good anymore.
My Income has dropped from between £2500 - £3000 per month to, if I'm lucky £750 - £900 in november. Thats a pretty big drop I think you can see. My problem is my outgoings each month are approximately £1100, (and thats been trimmed down from £1400) so I have a bit of a shortfall. I took the advice of the CAB a couple of months ago and moved my mortgage direct debit payment to another bank account I have, away from my main account. 95% of my debt is with my main bank Nat West. We have been scraping by for 3 months now but things are about to get a bit difficult. We have no savings, and no other forms of income. My young child only started full time school last September so my wife has been avidly looking for work ever since with no luck.
I have managed to pay my mortgage every month first and foremost, and then I pay the rest of my outgoings in order of priority, (ie council tax and utility bills)
I haven't just sat back and hoped for the best, but things don't seem to be getting better in the engineering business. so I think it's time to take some professional advice.
My main question is, would it be difficult to get my creditors to agree to a payment plan because I'm self employed.
My second question is, as most of my debt is with one bank, (£22000 loan, £6500 o/d and £3500 credit card), would they be less likely to accept any form of agreement.

As you know iv been having problems with wescot i got a letter from them this moring saying ,
Following your request for a copy of the signed agreement,we can conffirm we have returned the account to our client.Please contact our client direct for the information required,
Now i asked wescot to send me my subject access request witch i have payd for and have been waiting for for the last few munths,Now it seem to me thay could not get a copy to send to me and have sent the debt of £6299.59 witch has been up and down since this started back to naionwide,i took this loan out from nationwide almost 5 years ago now.I feel like im geting nowhere with this problem and am going around and around if anyone can help suggest what i should do now i would be very gatfull.
