Hi just new tonight
i am on a DMP with Payplan and have been for about 2 years now. i have just moved in with my fiance. He wants to put my name on mortgage and set up a joint account for bills. i pay half mortgage at moment but it is in his name. he has no bad debts. should i even consider this or will this put the house at risk? I had a basic account with Abbey and they recently upgraded it to a debit card (they said there would ne no credit check for this) i dont want to put my partner at risk or the house. Any advice would be appreciated greatly. Thanks

If your name were added to the property it could be possible for the creditors to eventually try and put a charging order against the property for your debt.
If you were to set up a joint account that would create a financial link between you and your partner which could affect his credit rating in the future. Otherwise your partner and his house would not be at risk.

Generally speaking if your house is in negative equity it holds no financial benefit for the Official Receiver (OR) to take your home, they may allow your partner to buy your share in the property for a minimal amount.
However no guarantee can be given that the OR would not consider the sale of the property.
It would be advisable to seek debt advice on your situation before taking this course of action to see if this is the most appropriate course of action.

currently my case of bank charges is with the ombudsman and has been there since october. i am under their financial hardship rules as various things such as 6 months behind on the mortgage, no rates paid last year son lost his place in school, they actually told him to leave he's 9 and why. (we are being sued by them and the case is to be held at the end of the month) but thats all another story at the moment.
lloyds who the complaint is about have not tried to resolve the matter of over £12,000 in excess charge they are still trying to intimidate me with soliitors letters even though the matter is with the ombudsman. well, i was on your webside last night and under debt free wannabe they had been talking about the credit consumder act and how if they have no signed agreement etc they cant prove a debt.
when all the trouble started i was 1,800 o/d now due to charges and interest i am over 4,000 o/d this cant go on and i was wondering what action i can do to bring this to a conclusion one being asking for my agreement on the overdraft. they have extended the limit from 1800 and now only charge interest, but not at my say so.
could you reply to me to get this matter finalised - many thanks

Hi I hope you can help me - my first time of posting. I have today received a Statutory Demand from Weightmans Solicitors in relation to Phoenix Recoveries - it is relating to a Marbles Credit Card. It was posted through my door by hand and was not in an envelope so could have been seen by anyone in the house !! It is dated 23rd December but was only put through the door today. I acknowledge the debt but have not received any corres to tell me that Phoenix had taken the debt on and noone has telephoned me or written to me prior to this demand. I had agreed a payment plan with Weightmans and was paying up to about a year ago when I fell on hard times - this is the first correspondence I have had in the last 12 months.
What do I need to do ? I rent my home and have no assets as such.
I was going to call Weightmans tomorrow and offer to pay £250 up front and then £200 pm - the total debt is £9888 is this likely to be accepted ?

Hello, I have recently filled in an online debt remedy but need a little clarification on one point please.
We have a 2nd property on the market at the moment, we just want to get rid now and break even, I filled in the form as receiving a lump sum from the sale of the property (after mortgage on it paid off) which would almost cover our unsecured debt so the reccomendation was to pay off the loans with the difference between the sale and mortgage owed.
However, this difference is actually owed to our parents so they have to be our priority (we're talking 30k here). To cover this I put that the house was worth as much as the outstanding mortgage on it - can I do this or we going to get into 'trouble' for over declaring the mortgage balance?0 -
Hi, we will have to start a DMP if I don't get a full time job in the next few weeks. I know I am clutching at straws but I don't want to do it now and then find I didn't need to. My worry is that we need to buy another car, it is essential for work as my husband has been leasing a van that has to go back now his business has closed. The only way we can buy a car is on finance. Not good when we are already struggling already but I don't know what else we can do as no family etc can help. If we o enter a DMP would a car on HP be included? as surely they would just take the car back.

Thank you for your message.
A car which is essential for work would be classed as a priority if there was no other way you could get to work.
So an allowance would be made on the budget for this if a DMP was the best option.
However, it would have to be the most basic and affordable.
It would be better if you could put some money aside and buy a cheap run around until you are back on top of your finances.
If this is not possible, then it might be an idea to sit down and work out how much is left over after paying all your main priority bills such as utility bills/rent/mortgage/food etc. This will show how much you can realistically afford for monthly payments for the vehicle if you did have to resort to HP.
If you fail to keep up the payments on a car on HP then the creditor could repossess the vehicle so it is important that you make sure the monthly amounts are affordable.
If you do not get the full time job you are hoping for in the next few weeks and find you are struggling and would like more help with this, you could ring for an appointment to speak to one of our debt counsellors on 0800 138 1111
They would also advise the best option for your situation as a DMP is not always suitable for everyone.

hi i contacted you few days ago about payment id made at post office that hadnt been recieved by cccs,ive sent reciept as proof off to you ,how long before i hear anything about it should i contact you or will it eventually show up on my online dmp?also just checked online statement and it says statement date 25th december payment due 1st febuary, but i thought as my dmp started january the 1st payment would be due 1st jan which is why i made it on 30th december.was it not due til 1st feb? and therefore the payment i made will count as my first payment to you when its found? or wa si right in thinking the payment was due 1st jan?hope this makes sense

Normally if you set up a DMP for the 1st of the month, the money is collected around this date and the money is actually distributed to your creditors on the 25th of the month.If your payment is late then the creditors receive a double payment the month after.
As I do not have access to your account details I do not know what date your DMP was actually set up to begin. I suggest you contact our client support team who would be able to check your account and answer your queries.

Hi,
I am a new member to this forum and was advised by CCCS to go online and ask, so heres my situation and would be most delighted for feedback :-
I am on contributed-JSA since Oct 2008 where my job contract finished. I have been applying for other jobs without success. I have 2 parts to my agreement with Northern Rock regarding my home. These are :-
1) A unsecured loan of £20k for 25 years which I am in arrears for the past 3 months and have received a default letter demanding payment which I cannot afford.
2) A 150k secured interest -only mortgage which I am again 3 months in arrears where the lender is demanding payment of nearly £5k
I have spoken to the lender this week and they advise to check if I am allowed Income Support on Mortgage Interest which after researching I am not I believe as I am on contributed-JSA.
I have my 13week JSA interview next week which I will discuss with the Jobcentre if I am allowed to convert to income-based JSA which if so will be allowed the ISMI benefit.
Can someone please advise me what I should do/get. I was advised to go bankrupt by the UK Insolvency Agent.

Bankruptcy is always the last resort and is not always the best option for everyone. Especially if you have any equity in the property.
It is difficult giving you advice via email as I do not know your full situation
However, the mortgage is obviously your main priority at the moment as you are 3 months in arrears.
I would suggest you ring us as soon as possible for an appointment with one of our mortgage advisors. They will help you put together a budget showing your income and expenditure and look at the best options available to deal with your situation.
We also have a welfare benefits support team who would also check to make sure you are receiving your full benefits entitlement.
