    Hello,

    Try not to panic; it’s unlikely that they will call to your property due to the cost factor. If someone does call, they are not a bailiff and don’t have the power of a bailiff so you could kindly ask them to leave and explain that you are on a DMP.

    Creditors are unable to send bailiffs for credit debts, the only way you ever have bailiffs regarding credit debts are, if you have a CCJ and you default on this. The court may then send one.

    If you send us a copy of the letters, we will be able to update your account.

    wELL I have continued doing as the CCCS advised i have been sending calder financial now the £1 token gesture who are trading as Mercers, so basically they are still the same people trading under a different name the adress is the same also, i send recorded delivery letters and expenditure updates last one on 3/1/09 they sent me a letter again today saying i have ignored there requests for paying this debt ????? and they said 48hr notice they will pass to another local debt collection who may call at your home, i have and are continuing to do as advised by CCCS , but they still put on £12 month late payment fee because i only send £1 so the debts just increasing What they exppect i dont know i have had this since May 08 1 letter a week from them , which i reply to each time .

    I can understand what you are saying and it’s not fair when you are trying to sort things out. Don’t let them pressure you into paying more, stick to the £1 payment. If they do send someone to your property this is not a bailiff so don’t panic, just ask them to leave and advise them this is all you can afford.
    How much debt do you have in total? Are there going to be any changes in your circumstances?
    Unfortunately there is no way of making your creditors stop the interest and charges, if you have asked them time and time again and they are still not willing you can have another appointment and we can have a look to see if there are any other options available to you.

When i spoke to LTSB collections today they said phone back at the end of the month and they'll discuss increasing my o/d to cover the proposed charges.
    The bottom line is all I can afford to pay is £73.70 a month iaw my DMP (which I presume LTSB have agreed to) but they're only reducing my £3300 o/d by £22 p/m. The figures I've worked out are at the start of Feb I will have paid LTSB £294.80 since the start of my DMP but my balance will be £3345 overdrawn when it was actually £3299.27 at the start of my DMP even though i haven't withdrawn or spent anything from the ac since the start of the DMP.
    Can anyone offer any help with this.:confused:

    You cannot pay what you cannot afford, so if the amount you are now paying on your DMP has been worked out as affordable after paying all your priorities then you should not offer any more.
    Unfortunately, the creditors do not have to agree to stop interest and charges. It is at their discretion. However, once your plan is up and running, they usually look at stopping them.
    I would recommend you contact our client support team and explain your situation. They may send a further request to Lloyds asking them to reconsider stopping the interest. If you send me a PM I will email the telephone number or you should have the number in the pack we sent you.

    Have you followed Debt Remedy right to the end to see what options are available to your situation?

    In answer to your questions…

    1) I really wouldn’t be able to say whether the surplus you have would be enough for a DMP to be the best option for you without knowing all of the information.

    2) If a DMP is offered, it’s not a legally binding contract so you could certainly end the DMP if you came into some money.

    3) It’s likely that if you went on a DMP your credit file will be affected, so you might struggle to get the most competitive mortgage deals. This does of course depend on what state the market it is at the time your term comes to an end. At the moment lenders are being very cautious with lending so a lot of people are struggling to get deals they could have perhaps got a few years ago, even with a damaged credit file.

    4) Although the merger is yet complete I would avoid banking with Halifax if you can, just in case they rebrand their accounts under the same name. Whilst this isn’t the case at the moment, it saves you the hassle should it happen later.

  • hi i contacted you few days ago about payment id made at post office that hadnt been recieved by cccs,ive sent reciept as proof off to you ,how long before i hear anything about it should i contact you or will it eventually show up on my online dmp?also just checked online statement and it says statement date 25th december payment due 1st febuary, but i thought as my dmp started january the 1st payment would be due 1st jan which is why i made it on 30th december.was it not due til 1st feb? and therefore the payment i made will count as my first payment to you when its found? or wa si right in thinking the payment was due 1st jan?hope this makes sense

    Following redundancy we took out a dmp with a company but they did nothing for us and took £25pm for the privillage. We now use stevenage CAB specialists even though not local. We have a £30,000 bank loan, a £12,000 finance agreement and credit cards. They have set up a plan where we pay £196 a month between the creditors. The bank loan and finance agreement have both been to court, both are ccj's and the bank loan keeps threatening for an order of sale but is currently accepting their portion of money on a 6 month review.
    We also have a £5,500 credit card which is costing us £111 a month which we are struggling to pay. As our credit rating is poor we cannot change to any of the 0% offers and im not sure what to do. My husband's salary is £16,000per annum and i am a full time mum. I have considered a part time job but then would lose benefits and our CSA payment would increase.
    Not sure what to do for the best.
    Any suggestion greatly appreciated.

    Yes, you have come to the right place for help!

    Its difficult to give you detailed advice via email without knowing your full situation.

    However, you could ring our free helpline for a telephone appointment with one of our debt counsellors.

    They would help you to put together a budget showing your current income and expenditure to see realistically what you can afford after paying all your priorities.
    They would then look at your creditors and discuss the options available to you.
    You would need to include all your current debts which would also include the credit card you have for £5500 and any bank overdrafts.

    Hi,

    I am a new member to this forum and was advised by CCCS to go online and ask, so heres my situation and would be most delighted for feedback :-

    I am on contributed-JSA since Oct 2008 where my job contract finished. I have been applying for other jobs without success. I have 2 parts to my agreement with Northern Rock regarding my home. These are :-

    1) A unsecured loan of £20k for 25 years which I am in arrears for the past 3 months and have received a default letter demanding payment which I cannot afford.

    2) A 150k secured interest -only mortgage which I am again 3 months in arrears where the lender is demanding payment of nearly £5k

    I have spoken to the lender this week and they advise to check if I am allowed Income Support on Mortgage Interest which after researching I am not I believe as I am on contributed-JSA.

    I have my 13week JSA interview next week which I will discuss with the Jobcentre if I am allowed to convert to income-based JSA which if so will be allowed the ISMI benefit.

    Can someone please advise me what I should do/get. I was advised to go bankrupt by the UK Insolvency Agent.

    I've done my own DMP and the majority of creditors have accepted my offers. However I'm having problems with Littlewoods. I owe them £496.08 and have offered them £1.94 per month. I have been sending them this for the last three months. They will not accept it. They've said that the minmum payment the company would be able to accept is 6 instalments of £34.

    They have said they "respectfully suggest you contact a debt management company such as the CCCS. Once they are dealing with your finances we can re-assess your offer of payment. ... You will need to request that they contact our Debt Management Team to renegotiate a payment plan for you and to also request that we hold all admin and interest charges being applied to your account ... I appreciate that you have already completed a budge sheet showing your income and expenditures, however, this information does need to be provided to our Debt Management Team from a debt management company to ensure that the information is accurate and up to date ... I must advise that if you do not act as suggested then your account will follow our normal debt recovery process."

    I'm at a loss as to what to do next. I don't really need to get CCCS to do a DMP for me as most of my creditors have accepted. Can you tell me what their debt recovery process is likely to be? Can you tell me what is likely to happen if it went to court?

  • Hi, I am new to this forum. After deciding to go on a DMP in December I made the mistake of signing up to a paying fee debt managament plan called MoneyWorries. I have spoken to one of your councillors and I am sending a letter to terminate my contract with the other company whom I have just paid £350 this month for absolutley nothing! I am angry and feel really stupid, I know the chance of getting it back is very slim buit I asked anyway as they have done absolutley nothing and contacted none of my creditors.

    I am hoping to start on your DMP next month and make token payments to the creditors this month after I recived a default notice form Egg and a DCA letter for £56 for Virgin. I have never missed a payment before so it is very daunting but I just couldn't afford to keep paying.

    My question anyway is I have recently got married, all the debt is solely mine and I had to admit to my other half just how badit had gotten and he was so disappointed and angry at me for which I don't blame him. We have a basic bank account with a small overdraft which we do not use but it is in joint names. The account is with RBS who are not linked to any of my debts, I strenuously checked that this was the case. Should I still change accounts? I don't want my debt to impact on my hubbie who has been very good with his money but shame about his choice of wife!
