HI There.
I was hoping you may be able to answer my query?
at the moment I share a flat with a friend, but wanted to also ask, if my circumstances change and I moved in with a boyfriend who has a mortgage, will I be allowed to pay half of the mortgage, bills and food. or will the OR not alow me to contribute towards his mortgage?

I have lots of non priority debts, i havent yet had a chance to total it all but i would imagine it is somewhere near £40,000 of debt. at the moment i am just about managing to pay minimum payments on everything but everytime one of the kids needs something essential, money for a school trip or we have to find money for a broken appliance or car repair it ends up pushing me further into debt. I really need to seek advice but as i have no stable income and my husband is on a low income i am expecting to be advised to go bancrupt. My children are totally in the dark as to how bad our finances are and i want to keep it that way but one of them leaves school soon so what i need to know is: if i go bancrupt how will it affect other members of my household with regard to their own future credit rating? will they be penalised for my mistakes??0

I've done my SOA, I've alerted my creditors that I'm experiencing financial difficulties - most of whom have responded and offered very reduced payment plans.
My problem is, I am struggling to pay for my rent, council tax, travel and food each week without paying my debts... how am I going to do it when I actually am?? I can't cut down on anything because I already am and I work from 8:30 - 7pm Monday - Friday, weekends I'm the sole carer for my stepson as my partner works late over the weekend so I can't even get a second job... what do I do?0 -

Just to clarify:
Regarding 1) I have already established there isn't a CCA, but they have filed a default anyway, does that mean I can have it removed? It was a catalogue that was applied for over the phone, which I received together with a credit facility, but I didn't sign anything and I didn't ask for or agree to a credit account verbally. I know by using the account I guess I have accepted something or other, but the fact that there is no agreement isn't even disputed by the company (just to clarify, they do now run a CCA system apparently).

It would be advisable to check with Consumer Direct 08454 04 05 06, regards the interpretation on if an agreement was put in place over the phone, and the enforceability of it.
If they say that no agreement is in place you can try and have the default notice removed by the company that placed it on your file. Ask the creditor to remove the default from you file, stating that they do not have a CCA in writing so they cannot issue a default on a non existent agreement.

this morning i contacted the company that has taken my electric debt over, to try and sort out a payment plan to repay the debt of £131.70, i offered £10 per month and they point blank refused my offer. i explained that i am a single parent on benefits and that was all i could afford to repay, but again they refused to accept my payment, is there anything else i can do they are threatening me with people coming to my door and also court action. tia x

I’m assuming that you are no longer supplied by the energy company so they are no longer a priority, so don’t worry they cant cut you off either.
No creditor can make you pay money that you do not have so stick to your guns and don’t give into the pressure. The people on the end of the phone may be working on incentives so will try and scare you into paying money you don’t have. Ask for a payment booklet or details for a SO to start making regular payments, but don’t set up a DD as they control how much they take each time.
If any one calls at your house to enforce the debt they are not bailiff’s only doorstep collectors who cannot take goods, make you pay money you don’t have or come into your property. Bailiffs can only become involved once the debt has gone to court and you have failed the CCJ.

Hi,
I am meeting with my nephew and his girlfriend on wednesday as they are beginning to get themselves into trouble. I don't know the full extent of it but what I know so far is this:
they owe about £600 to orange for a contract they couldn't afford to keep and this keeps increasing because they can't pay it.
they have a loan with provident so far up to date.
they have abother loan with another company so far up to date
council tax in arrears by a considerable amount - they have been in touch and are paying what they can
rent in arrears (I presume this is my priority withthem)
Credit card bills quickly increasing
In arrears with virgin for telephone etc
They promised to ring CCCs tomorrow but I wondered if I could begin to help them first.
My question is :
The Orange bill they seem to be ignoring and hoping it will go away - I know this is not going to happen. I am willing to help them out here if they can bring this down to a full and final settlement figure that I can pay for them - how likely is it that Orange will do this and how do I go about this - what kind of things would I say to them? The chancea are that if Orange don't they're not going to get anything as they are just getting deeper and deeper into debt.
I am very aware that although I can help them financially they have to learn to manage their finances because I can't keep bailing them out.
Any advice would be gretly appreciated.
Like I say I do intend to encourage them to be in touch with CCCS but I am aware there are lots of people out there with similar probs and wondered what I could do in the interim.

Hi I wonder if anyone can help?
We have contacted black horse with regards to a debt (unsecured that we have) after advice from ccccs and payplan who advised as we have no money left to make an arrangement to offer £1 a month.
We have just had a chap from black horse come round and we discussed facts and figures (where not bothered about as dont want to hide want to be upfront with them).
Our prob is that we also have a caravan with the same company but under a different agreement, after advice we have been told on hp have to keep paying it, which we are upto date. But he is saying they will take off us and pay the debt off the other loan as this is a luxury, he said we will then have to make an arrangement to pay off both loans as this is classed as a liability!!!!!!! can they do this and what are our options, we were going to sell in spring when season good and pay the debt off, but he said they prob wont allow us to pay the debt off, very confusing.
Also we have our mortgage with lloyds tsb and he was talking about mortgage attatchments!!!!
We have been honest with this chap and he can see the only reason we are in this mess is hubbys commision due to the credit crunch, we dont have masses of debt so cant cutback anywhere, which is where he agreed with us.

i have received my welcome pack today and it says my first payment should be december,which is fine..........but being as i dont get paid untill the 15th of december would this be ok to make a payment then? or does it have to be the start of the month?

I received a Final Notice from a company called ScotCall Debt Collecting Services today for £58.50. I rang and found out it was with regards to Plumb Center from who I bought a shower from in January this year - 11 months ago!
My cheque did bounce but was represented and cleared. Apparently from what I can gather Plumb Center used Certegy Limited to get the money for them and they in turn are now charging me the £58.50 for that service to Plumb Center. Thhis is 11 months ago though!
Can I contest this in any way as I got charged by the bank for the cheque bouncing and Plum Center got there money 2 days later?

Hi there.
If you believe that you have made full payment for the debt, then you can certainly contest it. It's up to them to prove you owe the money, and if you have got proof that you have already paid the money then it's they haven't really a leg to stand on. I would be inclined to draft a letter explaining the situation outlining the date the cheque bounced, and then later cleared amd advise you will be not paying anything more to this debt as as far as you are concerned the debt is cleared.

Hi there.
We would need to conduct a review with you ASAP to look at your situation. If there is not enough money spare after your living costs once your income has dropped right down then we would have to put the DMP on hold until you have found work again, and in the mean time make token payments.
I'd suggest that you call us as soon as you can and we can discuss this in much more detail.
