    Hello Sarah
    I have no intention of signing loan paperwork.
    i have another problem i opened a new basic acct with Nat West set up for my wages to go in and my direct debits to come out, tried to order something from amazon and card was rejected so popped in branch today and Nat West have closed account they wont tell me why but apparently they have 60 days, so i need to sort out a new acct quickly for my wages to go in and also my D/D to go out, i am still waiting to hear back from the co-op and tried the halifax who gave me a acct but whats to say they wont cancel my acct in a week or so.

    Hi Amy,

    When does your plan start? If it is the start of January, I would advice you to make a token payment in December as a goodwill gesture. In your pack you should have a letter to forward to your creditors called ‘notification of debt management plan’ you could send your payment with this.

    There will be no need to contact your creditors, as they will receive the letter from yourself soon anyway.

    Your mortgage will always treated as a priority in your budget, and you will just continue to pay this as normal. As they are separate accounts your mortgage will not be affected.

    If there are ever any changes in your budget, all you need to do if give us a call for a review. If your mortgage has gone down, then this money does need to be added to your plan.

    Hi,

    Done the online debt remedy and it has indicated a low start dmp or iva. After careful consideration I have decided to go ahead with the iva route in the new year. Up to press I have manged to pay minimum payments but now interest free period has ended on several of the cards etc cant keep up with this for long. Unsure what to do now before I look in to the iva, do I start on the DMP and then transfer to iva when I am ready to do so or will CCCS make me then stay on dmp? Or do I write to creditors and offer minimal payments? Or do I just amke the min payments as long as poss then go for iva? Dont want the iva to be turned down though if I have been making the min payments and credit rating still ok is there less chance of iva being turned down? As just cause I am making the min payments not paying anything off and cant live like this any longer, hoever will thy see it like this?

    This seems so unfair when I am actually aiming to settle my debts in full raher than go down the IVA route. Effectively my creditors in their actions are encouraging me to go down the IVA route through which they could only reap what I could pay over the next five years.

    Before I rush down the IVA route, would it make a difference

    1. If I could get them to agree to a set plan to pay in full (This is what MBNA have already done with a ten-year plan) would this be different or is it still a question of clearing the debt in full.
    2. If it does make a difference to the credit file quicker, is it a difficult thing in your experieince to get creditors to agree to?

    If you were on a set plan, again this may show as you having a reduced arrangement in place – this depends on how the creditor chooses to update your file.

    Each creditor does work differently and what you may find is some creditors are a lot more flexible than others.

    I am on a DMP with the CCCS and have been on this for about 5 years now and going well.

    The question i have to ask is that i have just been informed that my work contract will end next week which means i will be out of a job. Will the CCCS take me off the DMP if i cannot find work sooner or will they keep me on a low payment plan where i make a small payment each month instead of nothing. Not sure how i stand on this as its the first time out of work in over 8 years.

    Do they still keep you on the DMP if i was to also claim Job Seekers or would they also have to end.

    Also what if i went down the route of Self Employed

    If you have a credit card debt in your name and off your income when you first took it out. Then when you run into difficulties and go onto a dmp the credit card company ask for the household income and will not help any further until they have the household income even when you have an offer to them of your own income and not the household income. Can they do this?

    They cannot force you into showing a household income. If the debt is solely in your name you should show your income and expenditure, unless you have budgeted on joint income.
    What they may want to do is find out more about the household costs, possibly to see if your partner could pick up more things in the household to allow you to up your offers, and reduce the time to repay the debt.

    All this happened a couple of years ago. I read a couple of references to 2007 and I don't know what this means!

    1) The company in question should have had access to the original CCA to issue the default notice otherwise they wouldn’t know that the terms of the agreement to say they have been broken.

    2) If you have missed the timescales set unfortunately it will stay on your file.

    i have never used natwest before so it is something they have picked up when they done a credit search but why would they do that or they found out about my DMP? I was told they couldnt give me any credit i said just wanted basic acct for my wages to go into and my D/D to come out of.
    Have rearranged all my D/D this morning for the Halifax acct i got Friday afternoon and hopefully my pay dept will be able to send my wages to this acct pay day is on friday so i have my fingers crossed

    Just to clarify:

    Regarding 1) I have already established there isn't a CCA, but they have filed a default anyway, does that mean I can have it removed? It was a catalogue that was applied for over the phone, which I received together with a credit facility, but I didn't sign anything and I didn't ask for or agree to a credit account verbally. I know by using the account I guess I have accepted something or other, but the fact that there is no agreement isn't even disputed by the company (just to clarify, they do now run a CCA system apparently).
