    A default notice is nothing to be worried about, this is a legal requirement that ends the contract between you and the creditor. The default will stay on your credit file for six years.

    What they could choose to do is pass the debt to a collection agency, if they do, this just means you need to change who you are paying your pound to.

    Is there any way you can look at increasing your income? £100 is way under the guideline for a family of your size.

    When was the last time we reviewed your budget? If it is sometime ago, you could always come back for another appointment so we can have a look to see if there are any other more suitable options available for you.

    Hi there all the helpful CCCS people, Ive sent back my DMP signed form saying im going ahead and give permission to deal on my behalf. Just wondered how soon will i get my welcome pack in post with giro slip for 1st payment and DD mandate to set up.

    Also when will I find out how much they are paying each creditor?

    It should not take too long its, usually within the week if all the information is there that we need.

    Hello there,
    I am having a problem with TDM (tamarisk) debt recovery acting for NatWest. Despite my standing order being paid they are continually hassling for more.About 10/11 years ago I was in severe financial trouble but thanks to the CAB i am in a far better situation now but still stretched.
    This debt to the Natwest was subject to a CCJ,my main question is,can they demand an increase in payment on a CCJ?I have been paying this with no problems for about 10 years now.TDM do not answer the phone at all (indeed I think it may be disconnected).I would really appreciate your advice...Many thanks.

    After a Judgment has been set the creditor is able to ask for a review this is known as an order to obtain information formally known as an oral examination. This needs to be done in an official way by them sending you a form called N316. This form will summon you to court and ask you to take certain documents to prove your expenditure. If you have not received any paperwork then they can not make you increase your payments, as the amount you have already been paying is the amount set by the court.

    How much have you got left to pay on your CCJ and how much debt in total do you have?

  • Thanks for your reply.The debt is £9,051....)0riginally £11,200 (£5625 of which was an overdraft given when I was on a wage of £210 a week,the rest Charges on the current account) my other debts amount to around £3,500 which I am coping with,my credit score is improving all the time,I've gone from very poor to top end of fair but I'm worried about this TDM problem.
    The court order was for £5 a month but I've been paying £20 p/m for a while now just to try and make a hole in it !!....a big problem is that I have no detals of this original Natwest account and I don't want to rock the boat and ruin my improved credit rating (a ccj from Northumbrian water will be off in 2010 and I should be ok).

    You could always come for an appointment for us to look at your whole situation for you? We could see if there are any ways of getting this debt cleared quicker for you.

    Your credit file will repair in time anyway, what I always say to my clients’ is – a credit file is only important if you are wanting credit. So if you cant afford the credit you have, you shouldn’t be taking any more anyway.

  • Hi, I am not sure if this is the right place to ask/post this so my apologies if its not and please send me in the right direction as i am gettimg a bit worried now.
    I have an overdraft and remains of a personal loan with the Royal bank -a few years ago they served me with something to say they were going to take my flat and sell it to pay off the debts - after much pleading I managed to get them to accept £10 a month ( as advised by the CAB) - the debt at that time was £2280 approx. I have been paying at least double that for the last 4 years and then out of the blue last dcember I got a letter to inform me that my payments werent meeting the interest and could I make a lump sum or what more could I pay - the debt at that time (12/07) was over £22,000 - they had been charging daily compound (i think it is) interest - i had asked them to freeze the account and had not realised that they hadnt.
    I went to the CAB and the man there did a SOA and sent that to them on my behalf and thats it - thats all thats been done - I have phoned but he says he has not had any word back from them and he doesnt want to chase them up and 'upset' them!!! He had suggested that I took out a DAS for which I neede to have at least 2 debts - fine then but now my second debt is about to be paid off in 2 weeks time.
    I havent been able to work for almost 7 years through ill health - I receive all the benefits I am entitled - have recently had a review done - I am currently managing to pay £20 a week to the RB and when I finish my other payments next month that will be another £70 a month to the pot.
    What should I do? I dont know my next step - do I go to the royal bank - I am frightened they will say its not enough - I know I could pay it off if they stopped the interest.

    Hi,when I was first setting up my DMP with cccs I said I had a joint account with my husband and was advised to take my name of the account. I filled in the necessary form in the middle of August and thought that would be that but in fact my bank did not do it and we since found out that because there was an overdraft on it, it had to be authorised by head office. They cancelled all direct debits without our knowledge including all to our priority creditors among others. Then I recieved a letter saying they were accepting the DMP for my two personal accounts and the joint account was also included.
    An advisor at cccs told me to write to complain which I did but it crossed in the post with a letter from bank saying that because I had gone onto a DMP all accounts with my name on had to be included.
    Since then I've not heard anything and now am wondering whether I should include it, and how it will affect my husband. Not so much concenrned about his credit file but will they start to hassle him for the debt?

    I spoke to CCCS earlier today after filling in the debt remedy thingy online. Unfortunately I didn't really feel like it was of much use. I have about £3,500 of debt, incurred over many years when I was very depressed, and 2 CCJ's (One of which is illegal because they didn't inform me they were taking me to court, but anyway) I have phoned all my creditors and explained that I've recently lost my job, and am still waiting for benefit payments, but a few have got really nasty.
    The situation has got worse and worse due my fuctuating levels of depression, and it all came to a head this morning and I decided to sort it, but i now feel like no-one's willing to help.
    I don't really have any disposable income after benefits, and I don't know what to do.
    Could you help point me in the right direction?

    I am new to this forum but really hope someone can give me some advice. My husband and i have got ourselves into a lot of debt and we have been struggling to cope for months. We are both self-employed and got into arrears with our tax, we arranged to pay that off monthly, but we will have a new bill in January. Anyway last month i took the bull by the horns and went to CAB about our debts who then put me onto PayPlan. I spents ages talking to them and going through expenditure etc finally they concluded that we haven't enough excess money to go on a plan and suggested we offer all our creditors £1 per month. They sent me all the documents and letters which i promptly sent out to all the companies with my first payment of £1. We are now getting harassing calls several times a day (Barclaycard) some of which are automated. we are getting letters of default, letters from collecting agencies etc from them all, we have explained to them several times about our circumstances. I have kept copies of all letters and notes of call times/names. What should i do? ignore them! I am at a loss and very depressed about it all, I have ME and Fibromyalgia which are being made worse, I am also partially sighted.
    Any advice would be appreciated.
