Next Directory are requesting that I sign and return a credit agreement that they have sent to me over the weekend, saying if I do not return the credit agreement signed they will no longer be able to accept my DMP.
Obviousley they do not have a valid CCA and are using this letter as a smoke screen.
What is the best way of responding to this request, as they are currently accepting my DMP and have frozen all interest.
Thank you
Hello,
I would recommend that you call our client support department and have a chat with them about this as they would need a little more information.

hi there
i am having a bit of old credit card debt trouble.i have read all the threads on defaults on credit files and found them all so helpful but i have hit a brick wall.
My situation is like everyone else young foolish took too much credit on and could not afford to keep up payments.
This year i have been trying to sort it all out and was hoping to go for a mortgage.
i had two defaulted accounts with lowell for two o2 mobile phone contracts which i satisfied as soon as they defaulted in 2007 i could only afford to pay these two off. i tried to get the default removed but to no joy.
i got my credit report from equifax at the begining of this year and another two defaults where there from two credit card debts. These two defaults i know for a fact i did not receive a default notice for and with the help of this site i requested a cca from both of them.
The cabolt one i got a letter back saying they would try get the cca with in the twelve days as they where not the original creditors but 15 days later still nothing so i sent the follow up letter just have to wait the 30 days now so fingers crossed.
The other defaulted credit card was ulster bank and recieved a letter back 10 days later asking for the account number and sort code?? this was 4 years ago and i dont have them. I sent them all the information on myself over the years and the equifax report with the ulster bank default details. i sent the cca request again with all these details. i really dont know where to go from here if they still ask for account number and sort code??? i am willing to pay them i just want the defaults removed for payment cause i was hoping to get a mortgage at the end of the year and for the last four years my report has been really good i have not missed a payment in four years.
any help would be gratefull

Hi digitdemon and thank you for your message.
It is not always a good idea to take out extra debt to pay off existing debt as it could put you in a worse position.
The only way I can think of is to try for a balance transfer onto a 0% interest credit card. There are some good deals around at the moment but you have to take into account that there is an initial setting up fee, usually around 2 to 3% and you also have to consider what to do when the deal ends.
I have attached a link this site which gives the best deals at the moment
http://www.moneysavingexpert.com/cards/
There may be something on here you could try.
If you are struggling with making the minimum payments, and would like some advice, then you could call for an appointment to speak to one of our debt counsellors on 0800 138 1111.

Sue
Hi Sue,
Thanks for the reply.
I don't think I explained myself correctly.
By me applying for a card transfer or consolidation loan, and as I understand it, the automated systems these lenders use think I'm trying to get more credit when processing my application.
I've been told this is why I was turned down.
What I'm after is a process/lender that will do a card transfer or a consolidation loan and as part of the deal they close my existing cards. Therefore in an underwriters eyes I'm not getting any more credit, but simply moving it.
Hope that makes sense?!!
Thanks again,

Hi
I wonder if anyone can help.
I had a debt with Link Financial (original loan was with GE Money) of £8,000 which ended up in court and I now have a CCJ of £60pm due to start 15th April which I am happy with - or was until I discovered yesterday when Link Financial telephoned me to arrange for ways for me to pay it that they will be continuing to charge interest on this and the approximate figure would be
£130pm. This means that I will never be able to pay this off and will get deeper and deeper into debt.
Has anyone else got experience of this and have they managed to come to any
sort of arrangement with Link Financial at all (oh and by th way my debt has now jumped to £8,400ish between them taking me to court and the judgement,
(this being approx 6 months).
I would like to see if there is anyway they would either freeze the interest, reduce/cap it or even come to a final settlement with them. I would like the settlement option but when I tried to negotiate this before the court date they were not interested in giving any reduction whatsoever and the person helping me could not raise the full amount.
Please help as this has been hanging over me for a while and I am so stressed.
Many thanks

Can someone please advise regarding a court hearing for repossession, where the Bank holding an all monies charge 2nd charge are calling in the loans for £250k Would the Courts deal with this in the same way as if it was a normal mortgage? What would be the best way or making a proposal, no payments have been made for over a year and baiscally the Bank has advanced various sums over the past years by way of overdrafts loans etc for his business which has failed. The Court hearing is in a month so no idea whether he can get it adjourned as he may need more time to raise monies, he is hoping family can help him out so he could make some sort of offer, can he get it adjourned or does the Claimant also have to agree to this? Just trying to help him out as he's getting old and very stressed out about the whole matter, he doesn't want to lose his family home and is too old to get a mortage for more than 5yrs approx say (even though there is plenty of equity in his house.).Any advice, suggestions etc0

The mrs received a recorded delivery letter today, that she had to sign for, which turns out is from a DCA. It relates to a brewery for which she was a temporary landlord that claims she owes them a few hundred pounds. The brewery had not been in touch before about anything owed, (she left about 9 months ago), and the letter from the DCA gives no details about what it is for, other than the amount and comments like payment must be received within 48 hours or you risk a cjj and extra court costs etc.
Is it best to write or ring them asking for more information on what it is and to provide such information in writing? Or to maybe write a prove it type letter to the DCA?
Thanks.0 -

Hi Catherine,
Thank you for your message.
It is very hard to have default notices removed, as if one has been posted to you; it’s their word against yours. A default would only be removed if it was added in error which again you would have to try and prove.
A CCA request is to challenge a debt that you have never taken out i.e. being chased for someone else’s debt.
If your concern is applying for a mortgage, I would recommend that you contact a free whole of the market broker as they will be able to advise you on the best companies for your situation. If you have been paying regular for the past for your then I’m sure underwriters would take this into account when making their decision.
Regards
Sarah
