Hello all,
I am writing to ask for some advice on debt, that is my sisters. She is newly divorced, and has been left with some substantial debt. I have tried to bail her out but my pockets ain't that deep.
Her debts are as follows:-
1) £6,600 To Halifax for unpaid CC, now passed to debt collection agency. Who are demanding payment in full, or will attach order to her home.
2) £4,287.00 To Virgin CC (No demanding letters to date)
3) £2,955.00 To Tesco CC (No demanding letters)
4) £5,000 Personal Loan to Lloyds TSB
5) £2997.00 OD to Lloyds TSB
I know collectively there not a great amount but my sister is a single parent working full time and only earning £11,433 PA.
I have already contacted her mortgage company who have agreed in principle to put her on a 2yr interest only mortgage, which has reduced her bill from £349.00 to £136.51 pcm.
I would like to know if there is any way we can contact the creditors and ask for a interest freeze, and a fixed monthly payment.
What can you advise?? I have already taken her to a so called adviser, hoping to get an IVA but got told that on her current financial status it was hopeless, and she should sell her house!!
She's worked very hard for 22yrs to keep her home, and with only £65,000 left to pay seems stupid to sell now. Beside she would never get another house like the one she is in.
Any help is greatly appreciated

We have just started a debt management plan with yourselves and will be making the first payment tomorrow.
My partner and myself have now split up, we have still got to sort out all our finances, house etc but i'm after a little bit of advice.
The only thing on the plan which is joint is our HSBC current account overdraft, once everything is sorting I will be stopping my debt management plan as I'm sure I can plow all my money into paying them off quicker. We have no equity in the house so if we sell we will both walk away with nothing.
How would it work, would I just need to get my details removed from the debt plan so it is just his and the budget updated accordingly if he wanted to continue ?
How would it work with the joint account debt - I could pay my half but I doubt the bank would remove my name until its all paid off.
Just trying to get an idea of how things would work out. We will continue with the finances and debt management as is for the moment until the decision is made about the house

thanks Amanda so all I can do here I guess is remove the last of the cash from BoS and send them back my bank card with the notice that I am entering a DMP and ask them to bounce the cheques then add the Pay Day Advance debt to my DMP?
You could speak to the payday loan company initially and see if they can give you the cheques back as the bank may charge you to cancel them. If not its not a issue because any outstanding money will be added to your DMP.

You were right. They have asked for the full balence 'forthwith.' Will now need to take a day off work to go to court. Can't believe it! Am so upset that I now have to tell my employers about the whole situation. I just hope the Judge can see we are doing what we can and agrees the amount. Thanks for your reply.

If you contact our client support department they maybe able to send them a letter asking them to again accept the offers. Try this and see how you get on. If this does not work then let me know and we can see if there is anything else.

The DLA is for your daughter’s disability and not to pay debts, as long as the costs are accounted for in the budget i.e. high taxi costs it should not be a problem.

I have been asked to prove the last six years worth of addresses in order to get my experian credit report and I can't.
The situation is that a friend had a council flat in my area in 2003 and she got married and planned to move 200 miles away.
I was in a nightmare situation ( pregnant and about to become homeless) so we did a silly thing and I moved into her flat when she had gone and we didn't tell the council. I paid the rent and council tax every week in her name as there was no housing benefit involved from Oct 2003 - August 2004

They've asked for six years of proof and I have a gap between Nov 2003 and Aug 2004. As everything was in her name I have zero paperwork of any sort for that 9 month period.
I've battled back up since and now run a small business. I got a lump sum from a client and paid off some very overdue council tax and water bills which I **think** I have CCJ's for ( I went through a STUPID bury my head in the sand and throw away all letters unopened phase:mad:). I want to apply to have them marked as OK on my credit report but I can't see how I can get my credit report if I can't prove where I was for that gap
Can any one help - so upset and annoyed with myself.
I could wait until Aug 2010 when I have 6 years backdated proof of address but that seems crazy

Good afternoon - my old bank must have noticed that I have stopped my salary and benefits etc being paid into my account. It's funny how I was pro-active in sending letters to keep them informed at all times and offering a monthly payment to pay my overdraft off etc, then the only time they start to reply is when they notice there's no regular money being paid into their account for them to eat up in fees!! I received a letter this morning stating that they have been trying without success to contact me via mobile (this is totally untrue as I get caller display) and they also have my home number if they really tried hard enough. They are now saying that they received my letter offering repayments on my oustanding overdraft (this was sent a month ago!). I have already sent them a statement of affairs and all info they requested and they are wanting me to visit the branch to tgalk about a way forward!! Why would I need to do this when I have already given them all the info and because of their not being v helpful. Do you know if I really DO need to go into the branch to see them face-to-face or are they trying to put pressure on me? Thanks.
You don’t need to see them; I would recommend you just keep making your reduced payments as normal – Anything important they will send in writing anyway.

Hello,
A default is pretty standard stuff; it basically means that they are ending the contract between you and them. They will properly now pass the debt onto a collection agency. If they do pass the debt on, let the CCCS know and we will switch who we are paying for you.
You don’t need to do anything, just keep paying your monthly payment as normal.

It would be a good idea for your sister to visit Debt Remedy, this is an online debt advice system. Your sister would just need to input details of her income and expenditure and she will be provided with advice on the best way to deal with her situation.
