  • hi i am fairly new to these boards and have just set up a dmp with the cccs i made the first payment last week i have found out today that my 10 year old daughter is able to get dla for care and getting around do i need to phone cccs up and tell them as this money is ment for my daughters care not for debts but i dont want to upset the cccs by not saying anything thanks
  • Hi Sunnydais,

    If your account with the Bank of Scotland is overdrawn they will not let you close the account. When the cheques are presented, if there is not enough money in the account, the bank will return them and charge your bank account. To ensure that you have enough money this month to live on you could take all of the money from the bank account prior to the cheques being presented.

    We will just include the debts to the cheque cashing company on your DMP.

    thanks Amanda so all I can do here I guess is remove the last of the cash from BoS and send them back my bank card with the notice that I am entering a DMP and ask them to bounce the cheques then add the Pay Day Advance debt to my DMP?

    Thank you for your post.

    When you complete your forms northern Rock will have an opportunity to review them and decide whether they will accept your offer. If they do not accept your offer then the form you complete will be sent to the court for the court to asses your offer. As long as your offer is reasonable the court should set your judgement at the amount you have offered. As long as you make payments to the judgement you should not get a charging order on your property.

    The only problem you may have is if Northern Rock asks for your payment forthwith, this means you have to pay all of the balance straight away and as you are unable to do this the judgement would fall into default. If a judgement is in default you probably would get a charge on the property. However, you can defend a charging order.

    If you were to get a charging order it does not mean that you have to move. A repayment will be set on the judgement for you to pay; as long as this is paid you should not have a problem. Creditors sometimes apply for charging orders to protect themselves if you were to sell the property.

    You were right. They have asked for the full balence 'forthwith.' Will now need to take a day off work to go to court. Can't believe it! Am so upset that I now have to tell my employers about the whole situation. I just hope the Judge can see we are doing what we can and agrees the amount. Thanks for your reply.

    Hi there,

    We normally include DLA as income on our budgets, but then offset any care costs on the budget that your daughter may need.

    You could call our client support line and they will adjust your budget and include your care needs for your daughter.

  • I have been on a dmp for about 6 months now and all seemed to be going OK (apart from having to reduce my payments as we couldnt afford to live) and i have just received a statement from my lloyds credit card & they have been paying themselves money (to make up the shortfall) out of my bank account, so have made our bank account go well into the red, so I am going to get massive charges, my cerdit card on the other hand is fine, obviously they have been topping up the DMP payments from my overdraft so i am not behind on my credit card, even have £500 available balance! (for the record I dont use this account now as it is included in the dmp)
    Can anyone help here at all? what can I do???

    hi thanks but wont my creditors play up about us having extra money but not giving any of it to them i mean wont they say how come they are now paying for after school clubs when they wasnt before why do they now need taxis when they didnt before like i say i dont want my daughters dla beening taken by my creditors its not why the goverment gave her the money but i dont want to get into trouble by not saying about it thanks
  • I am at a total loss as to what to do and any help would be appreciated.

    I have been asked to prove the last six years worth of addresses in order to get my experian credit report and I can't.

    The situation is that a friend had a council flat in my area in 2003 and she got married and planned to move 200 miles away.
    I was in a nightmare situation ( pregnant and about to become homeless) so we did a silly thing and I moved into her flat when she had gone and we didn't tell the council. I paid the rent and council tax every week in her name as there was no housing benefit involved from Oct 2003 - August 2004

    In August 2004 I half came clean to the council and went to the council and said that she had moved away and that I had been staying with her and applied for the tenancy which was granted in August 2004

    They've asked for six years of proof and I have a gap between Nov 2003 and Aug 2004. As everything was in her name I have zero paperwork of any sort for that 9 month period.

    I've battled back up since and now run a small business. I got a lump sum from a client and paid off some very overdue council tax and water bills which I **think** I have CCJ's for ( I went through a STUPID bury my head in the sand and throw away all letters unopened phase:mad:). I want to apply to have them marked as OK on my credit report but I can't see how I can get my credit report if I can't prove where I was for that gap

    Can any one help - so upset and annoyed with myself.
    I could wait until Aug 2010 when I have 6 years backdated proof of address but that seems crazy

    Can anyone advise ????

    Good afternoon - my old bank must have noticed that I have stopped my salary and benefits etc being paid into my account. It's funny how I was pro-active in sending letters to keep them informed at all times and offering a monthly payment to pay my overdraft off etc, then the only time they start to reply is when they notice there's no regular money being paid into their account for them to eat up in fees!! I received a letter this morning stating that they have been trying without success to contact me via mobile (this is totally untrue as I get caller display) and they also have my home number if they really tried hard enough. They are now saying that they received my letter offering repayments on my oustanding overdraft (this was sent a month ago!). I have already sent them a statement of affairs and all info they requested and they are wanting me to visit the branch to tgalk about a way forward!! Why would I need to do this when I have already given them all the info and because of their not being v helpful. Do you know if I really DO need to go into the branch to see them face-to-face or are they trying to put pressure on me? Thanks.

    I wonder if you could offer some advice please.

    I started a DMP with you in June with everybody stopping interest. However, today I have received a default notice from Citibank saying I need to pay £900 by 28 November or else they may take me to court.

    Can you tell me what I need to do. Should I write advising that I am already on a DMP with them and they are getting X amount each month?
