hello all
i am currently on a self written dmp with all my creditors!!!which after loads of months they have finally accepted. i have been made redundant today ( have known for a few months) and will be getting a nice sum of money....
i want to pay off some of my creditors once i get another job and have been offered massive reductions as a full and final settlement
ie owe debt managers/barclaycard £6500 offered to accept £2500 to settle. i have this in writing but it seems too good to be true.....
as a full and final does this mean no reclaim charges are allowed....does this mean my debt will be sttled...
please help as i am confused....

I would like some advice, I am on ESA and get £89.90 a week (paid every two weeks) until August I was able to keep up with repayments of an unsecured loan with Nat West by using my redundancy pay.I owe them £6,700 and owe Tesco credit card £800. Redundacy money has now run out and I used CCS services and did my budget with them. Budget was pared to the absolute minimum and left £60 a month and they advised me to do a DMP which they would adminster giving each creditor £30 a month. To save money I have had my land line disconnected, budet £0 for clothes, entertainment, repairs, haircuts. I am not well enough to work at the moment. I am concerned that if I do the DMP and something happens such as an emergency (heating breaking for example) I will have literally nothing. Also as I have variable direct debits with for gas and electricity, what if they are increased? I keep trying to phone CCCS but can't get through and it's an 0845 number which as I only have a mobile costs me 20p a minute. I am planning to try and get some part time work as soon as I am well enough and then maybe a DMP would be a more feasible option. Also I am only on this benefit for the next 6 months and as a condition of it I am supposed to be geting "work ready" by seeing a personal adviser. Nat west have been making noises about a charging oder on my property which I own outright but is only worth approx £79000 so selling and downsizing is not an option as this is what people actually downsize to. CCCS did also mention equity release and said that someone would phone me to discuss this, but noone has. I'm very unsure about how to proceed. Thanks for reading this0 -

About 8 years ago we had some financial problems and used the cccs to sort things out. We were on a dmp and after about 2 years we sold our house and were able to use the released equity to offer 75% of our debts to all our creditors. Most of them accepted this but 2 or 3 didn't. Out of these one is still outstanding. This loan was subject to a ccj and through the cccs we agreed a monthly payment which we have been paying to the companies solicitors ever since.
This week we received a letter from an unknown company saying they now had the loan and asked for the outstanding balance. They offered no information to help tie them to the original company. Since then they have phoned several times a day demanding a financial statement.
It seems that they have bought the loan from the original company (we have confirmed this). My question is how much information do we have to give them regarding our financial situation. I am unimpressed about the way they have dealt with us so far. We are up to date with all payments and would prefer to keep paying at the rate we agreed via yourselves. We could probably pay more but feel that we have set our budget around this figure and as this new company have probably bought the loan for a lot less than is outstanding it seems unethical for them to demand an increase. How do we stand with this situation. Do they have the right to demand financial information if we do not wish to enter into an arrangement with them. Hope you can help. Thanks for reading.0 -
Hi - my DMP is starting in October and most of my creditors have been co-operative and understanding, and I have been paying them token amounts until the DMP takes effect.
However, I have received a default notice from co-operative bank today regarding my overdraft with them and basically threatening me with court if I don't pay them the whole amount before 11th October. As far as I'm aware, they know I am now on a DMP and wouldn't be aggressively chasing me (phone calls at all hours, letters, etc) if I hadn't informed them I was going on one.
What do I do about the default notice? I don't want to talk to them on the phone as they are quite aggressive, and the CCCS counsellor I spoke to last week assured me it was simply a matter of waiting for the co-op to sort out their paperwork as a proposal for payment has been sent to them. I'm feeling anxious because the token payment I tried to send them doesn't seem to have left my account and I'm scared I will be taken to court. I have also noticed the balance of the account has gone up (presumably a charge has been added).
What sort of letter should I send them to stop the harassment and prevent this going to court?

A default notice is very common one you enter into a DMP and it’s nothing to be worried about. A default is just basically a legal requirement that ends the contract between you and the creditor, so they could choose to pass the debt on to a collection agency.
Creditors are able to send these letters, however once your DMP is up and running these should settle down. You may want to have a read through the DMP mutual support thread on this forum as the is a lot of useful info from people in a similar situation as yourself.

hello - i am looking for some advice.
my OH and i are in a real pickle since he lost his job earlier this year. he has a new job BUT it does not cover our outgoings and we have a huge amount of credit card and loan debt. I have arranged a couple of self managed dmp with some of the companies we owe money too - but now its getting too much and i think i have to get someone to do it properly as i am really struggling with the stress of it all.
if i speak to cccs in the morning and go through all the out/in goings -
how long is is before we are on the official plan?
what sort of amount are the token payments?
will they come and take our cars away -and
do i try to make payments before i am officially on the plan?
can we keep our house?
can we make overpayments to the dmp when things get better?
please can someone help ... i am getting close to end of tether.

how long is is before we are on the official plan? As soon as you have an appointment and send the paperwork we can get it set up, plans always start from the 1st of the month. DMP’s are not always everyone’s best option though so your counsellor will need to take a look at your budget first.
what sort of amount are the token payments? Token payments are whatever you can afford, it could even be £1 if that’s all you can afford
will they come and take our cars away - Nope
do i try to make payments before i am officially on the plan? Again, a dmp is not always your best option. Make token payments until you have had your appointment then your counsellor will let you know your next step.
can we keep our house? I don’t have all you information so would not be able to answer that one, sorry.
can we make overpayments to the dmp when things get better? If you have any extra money, then yes pay this towards your debts as it would reduce the term down.

I would go for the full and finals first of all, as you may not want to push them too far. If you managed to save a lot by full and finals that would be fantastic. You really need to make sure that you have everything in your budget that you need i.e. money for clothes etc, these are your priorities
If needs be, you can always offer your creditors £1pcm until your back in work.

If this debt is a CCJ then they should not be asking you for more, the correct procedure as far as I am aware is they would have to apply to the court for a re determination and then you would have to produce a copy of your budget on the court forms.
Is the new company aware that this debt is a CCJ? I would recommend for the moment that you just continue making the payments agreed by the courts.
