My son phoned CCCS today to discuss debt problems. He signed on to Jobseekers this morning and therefore cannot currently pay his monthly debt payments. He was given a refence and will be interviewed on 17th July. In the meantime they have suggested we contact creditors and offer £1 token payments stating he has an appointment with CCCS and was advised by them to do this. He is not looking forward to it but my son is going to the Natwest bank tomorrow (one of the creditors) to offer token payment and cancel all his direct debits. He is going to take a letter confirmation plus £1 payment but should he also give them a copy of his statement of affairs showing all the other creditors debts. We are going to write to all the other creditors, once again at this stage should we send a copy of the statement of affairs. He will also be opening a basic Lloyds bank account tomorrow.
Can you please advise asap.0 -
Well, having thought about this, the problem with the CCA I posted is that they did not include all the terms and conditions as part of the agreement, so I guess that means the CCA is unenforecable. A separate book of T+Cs was not allowed at the time I signed the agreement.

As you must realise this agreement does not conform to sections 60(1) and 61(1) of the Consumer Credit Act 1974 and would therefore only be enforceable by a court under s65. However, the absence of any (prescribed terms / signature) means that a court would be prevented from enforcing it under s127(3).
I am granting to you a further 21 days to produce a copy of an executable agreement. After that I will consider that the above account is closed and that you will no longer pursue the alleged debt.
After this period you should close the file and cease processing an personal data relating to me on this matter.

My friend is now almost set up with a DMP but is having a bit of bother with RBS. She has a royalties account that costs £12.50 a month and also the standing order for the loan comes out of that account. We went into the branch to cancel the standing order and close the account but they refused saying that they could not cancel the standing order as it was part of the loan credit agreement and so they could not close the account with an open standing order!
She has no money in this account so is going to get charged everytime they try and take the standing order and also the £12.50!
As part of her documentation we sent a copy of her bank statement for this account to yourselves but have not included the account as a debt since it wasn't one then but now it looks like it might turn into one!
We explained that she was going onto a DMP but they didn't really seem to care about that.
I work full time so find it hard to find the time to call yourselves during office hours, if I do call about this is there anything CCCS would be able to do? Could you talk to RBS on her behalf and get them to cancel the standing order and stop charging the £12.50 a month? I really don't know what to do

Your friend would need to get the overdraft added to the DMP as soon as possible, this is so it would not class as adding a debt once the plan is up and running.
It is usually the case that the bank won’t allow you to close the account when there is money outstanding. Once the DMP is up and running then this may stop the bank taking the payment, as they will be receiving the reduced amount through the DMP.

Not to sure what you mean by secure a property in the UK, however with IVA’s your main interest would need to be in the UK i.e. spend the majority of the time in the UK.

I currently have a DMP with CCCS and have emailed you on my 'homepage' on CCCS regarding doing a possible F&F IVA but have not had a reply yet. What steps do I need to take? HELP CCCS person/s!
I am concerned as my dmp online is showing that payment was taken as usual (standing order), but on my dmp statement it says no payments to creditors were made?
I had a letter recently from cccs saying that you would still process my dmp - it's not my fault that cccs phone me when I specifically told you what hours I was working yet you still phone during those hours?!
I have yet again sent a message requesting when to be telephoned for a review.
I'm not sure if it's just me that is having a statement oddity, as my husband also has a dmp and his says the same thing.
Meanwhile my hubby & I are getting red / harrassing / threatening letters from creditors again. Thanks.

I’m not too sure about the statement as it’s our client support department that deals with that side of things – I will PM you their number to call.
You would also be able to call for a review when it’s convenient for yourself, they can do it there and then for you if you have your figures ready.
With regards red, you could send them the following letter to get your number removed.

I hope to set up a DMP however I have a couple of queries. Firstly the first company that approached me about the possibility of a DMP said that I would need to open a new current account as one of the credit cards I hope to include in the DMP is an HSBC card and I have had an HSBC account for nearly 20 years. I would prefer to keep the account if possibile or will I need to change to another bank? I also have a £2,000 overdraft with HSBC.
Secondly,is it wise not to include all the debt you have in the DMP? For example I have one credit card with a smaller amount than the others and the interest is 0.1% for the life of the balance I was thinking it might be best to tackle this seperately. Also, if possilbe I would like to have one working credit card for emergencies. I don't intend to create further credit card debt as obviously my objective is to be debt free but would like at least one credit card I can use in an emergency. For instance recently I had to have my boiler replaced asap before my baby was born and this required me having to use a credit card as I would have had no other way of paying. Is it possible to have a credit card available for such situations even if I have a DMP?

When trying to get on to a DMP are the figures used by CCCS to come to an arrangement with the creditors that of the outstanding balance or that of a final settlement figure which with a loan can be lower then the OB.
Also, my income and outgoings would allow me to pay off my debts in 9 years and 5 months with the money that i can afford to pay to the DMP from the start altho this payment could be increased when ive paid off arrears to mortgage thus in turn reducing the repayment time. Is this likely to be acceptable to my creditors?0 -

Just got confirmation from CCCS that my DMP starts 01 July.
I spoke to an advisor at CCCS. Because my DMP starts on 01 july my creditors will get their next payment at the end of July. Obvioulsy I have some minimum payments that are due before that. CCCS told me to send the £1 token postal orders to those due. I asked if their was a covering letter template I could use, but apparently there isn't (previously sent the notification DMP letter from CCCS already). Does anyone on here have one? Advisor suggested creating own one but don't want to get it wrong.[STRIKE]£67000[/STRIKE] in unsecured debt at LBM June 2009:eek:
