Hi, I have 3 credit cards which I took PPI out on each of.

I am self employed but due to the recession have had only 2 weeks work since Christmas.
I was self employed since 2001 and got the cards in 2004/5.
Now when I claimed for the PPI on my cards, 2 of them will not cover my unemployment. I am claiming Jobseekers allowance all £64.30 of it.
I have no savings as I've used them all now. I have my mortgage, elec and gas bills piling up too, as I thought using my savings to pay a cursory payment to my cards was a good thing. Struggling with my mortgage too now but DSS are gonna pay the interest on that, I hope.

My barclaycard is great they have paid my PPI no problem

I have claimed my mis-sold PPI from Halifax, they seem ok that I am unable to pay anything and the PPI mis- selling seems to be under way but,
my MBNA card even though i've told them that my mortgage comes first and that I have no savings are constantly harrassing me.

Now as far as I am concerned I took THEIR policy that THEY mis-sold saying i'd be covered if I became unemployed. I cannot afford the payments.

I have written to them, and have now stopped answering their sometimes twice/three times DAILY calls.
My phone has been reduced to incoming calls only, I spend my day on the internet looking for work in the library/ job agencies/ job centre, and come back to find numbers of calls being left and irate messages.

Now I can't call back, due to incoming only. Should they back off until the result of my mis-selling comes back, i'm also claiming for the interest too, as it's been 4-5 yrs of £50 a month.

I don't deny I owe them money but they're adding more and more interest all the time. I'm ready to run off (if I could afford it)
I believe they are at fault!. Can I stop the calls? MBNA i'm not happy.

    I'm raging really!

    What should I do?

    Thanks

CCCS please take note as i'd like to talk to you (thanks)

Hi, my son in is debt crisis. He has credit card, loans and overdraft debt totalling approx £15k. He was self employed until last October when work dried up. After a short period on JS benefit he got a private hire licence and has been driving for an operator on a self employed basis which has not worked so is ceasing trading this week so once again will have to rely on JS, HB & CTB until he can find another job. He has managed to survive with our help and so far has been able to keep to minimum payments but the time has come for him to manage his own debts. He has done a SOA and there is no monies left over to even meet minimum debt payments nor to clear debts by DMP. I have an amount of £7k which I am willing to give him to help clear some of the debt but am unsure the best way to use this, should he:-

    1) Should this be used to clear largest and most expensive credit card and current overdraft, then offer the remaining creditors token payments

    2) Should we use it to offer all creditors pro rata full and final settlements.

    3) Should I drip feed it monthly to use for a DMP, if so how would this be shown on a budget sheet.

    Any help would be appreciated

    Hello,

It might be worth your son having an appointment to speak to a counsellor, so they can take a look at his whole situation.

As general advice, if he did have the £7000 he could look at clearing as much of the debt as possible via full and final settlements, then if there is any money left over he could possibly look at a reduced payment plan. However, would be best to have an appointment to confirm this.

In the meantime, he will need to look at offering his creditors goodwill gesture payments – this can be however much he can afford even if this is £1. The best way of making the payments is either through standing order or payment book rather than direct debits.

If he has any debts with his bank, he will need to open another account somewhere else. This is to ensure they don’t have access to his money.

If he would like an appointment he can call our helpline on 0800 138 1111.

    Hello,

You would be able to ask them in writing to stop calling you. I have added a letter below that you could use to send to them.

Let me know how you get in with it.

    To whom it may concern

    Dear Sir/Madam

I am writing to ask that you no longer contact me by telephone as your calls are causing me considerable stress due to the frequency, and that they are being made at inappropriate times. Please remove my telephone number from your database and send all future communication in writing to my home address.

I have provided the most recent copy of my income and expenditure to make you aware of my current financial situation. I will continue to make my payment of x on the x of every month and will keep you informed of any changes in my circumstances as I am keen to resolve this issue as soon as possible.

I understand that following this request if you continue to call I can contact the Office of Fair Trading to make a formal complaint.

Please confirm in writing that your records have been amended.

    Yours sincerely

    Hello,

If there has been a change in your friends budget she would be more than welcome to have another appointment, we will change the figures in the budget and see what other options are available to her.

I would not be able to say for sure if a dmp would be an option for her, as I don’t have her budget to look. On rough calculations it would take her around 8 years to clear her debt on those figures if the creditors were to stop the interest and charges, so could be a possibility.

In her booklet, there will be a contact number, if she calls that then they will arrange another appointment for her.

    Sarah

Thanks Sarah, we are getting there. Called back and setting up a DMP for £377 a month, she is very scared about how the creditors are going to react but I'm hoping it will be okay.

    Hi Sarah
Wondered if you could offer some advice.

Did the online debt remedy, recommend a DMP so OH is awaiting his pack and info in the post. We are going to cancel DD's and open a new account for him this week.

In the meantime we are a little confused about 2 of his creditors.

    • One is The Money Shop, cash advances. If we do not pay the £15 extension fee per cheque they will lodge them. There will be no money in the bank for them, but he does have a cheque guarantee card so they will be cashed and then he will owe the bank. Is there a way round this, like going into the Money Shop and explaining about the DMP etc?

    • The other is Orange. Currently OH owes the around £80 in arrears, but contract is for £35 a month which he will not be able to pay in the future. We have added them to our list of creditors for the £80 plus the remaining months of his contract adding up to £220. Is that the right thing to have done?

    Thank you.

    Sorry Sarah, another wee question.

    • He has a loan with Welcome Finance for £3000. However the interest is 61%! He has made 6 months worth of payments off this loan so far, the loan term is 36 months. I wasn't sure what to put on his list of creditors/debt on the debt remedy, so I put £3k minus the 6 months worth of payments. Would that be right? Or should I have put a different amount? Can he change this over the phone if we ring you guys with our web ref number?

    Hi Sarah,

I owe £4,600 to Littlewoods Credit Card and despite numerous attempts at negotiating a reduced payment they sent me to a credit agency called Mercers.

I contacted them and they agreed to accept my reduced payment of £46 per month but wouldn't accept unless I paid an initial payment of £160.00 which I agreed too, but he said that payment needed to come from debit card right away, so I gave him the details over the phone of my debit card. The payment hasn't gone out of my account yet, however, I'm worried he will take more than that amount OR take that amount each month instead of the agreed £46 (which I am supposed to set up a standing order for) - a dreaded recurrcing payment. As my wages go into that account, I'm understandable worried.

Should I be worried? Or is thia normal practice?

Thank you for any advice you can give me,

    Sibbie.

I need help from a CCCS member of staff.

I joined my dmp back in 2006. I owed barclaycard masterloan £4,000 I have sinced paid back over £3,500 and now owe them £470 or so I thought.

Back in October I received a letter telling me to change my account number and sort code for my payments which I did..... have since found out this was meant to be a reference only and was not an account number or a sort code!

Payments have now started to be returned to myself as they could not link the payments. This has been happening for 6 months nobody telling me there was a problem.

Barclaycard had me in the collections department and I was being charged 21.74% apr on what was already a 23.9% loan with front loaded apr.

They are now saying I owe £2.750.00 or there abouts, When I ring cccs Im told they can't help me and that I need to ring Barclaycard and when I ring Barclaycard im told to ring CCCS.

This has majorly set back my debt free date it seems like it will never end with all these apr and charges.

They are yet again returning payments, don't seem to be having much luck with Barclaycard at all they keep giving me the run around.

Without being able to see your account on screen it's a bit difficult for me to be able to see what's happened here. You really need to speak to someone from Client Support (PM me if you need the number) as they should able to advise further.

However if you haven't already done so I would suggest getting in contact with Lloyds to confirm what they have as your account numbers and ensure that matches with the details we have on system from you.

    Hope this helps,
