Hi
My friend is now almost set up with a DMP but is having a bit of bother with RBS. She has a royalties account that costs £12.50 a month and also the standing order for the loan comes out of that account. We went into the branch to cancel the standing order and close the account but they refused saying that they could not cancel the standing order as it was part of the loan credit agreement and so they could not close the account with an open standing order!
She has no money in this account so is going to get charged everytime they try and take the standing order and also the £12.50!
As part of her documentation we sent a copy of her bank statement for this account to yourselves but have not included the account as a debt since it wasn't one then but now it looks like it might turn into one!
We explained that she was going onto a DMP but they didn't really seem to care about that.
I work full time so find it hard to find the time to call yourselves during office hours, if I do call about this is there anything CCCS would be able to do? Could you talk to RBS on her behalf and get them to cancel the standing order and stop charging the £12.50 a month? I really don't know what to do

Thanks for your message.
This is quite common and, as they will not cancel the standing order, another debt will be created. They will not continue to take the loan payment indefinitely, but will probably take approximately 2-3 months. This will mean that the loan balance will decrease for a few months whilst the overdraft is increasing. Usually when they receive our proposal they will look at taking action on the accounts.
We will add the debt onto the DMP. All your friend has to do is contact us on our client line, this number will be on the pack that we sent to her, and advise them about the account.

Today I got a letter from Equidebt who claim they have been instructed by HSBc (ie 1st Direct) to collect the money. it adds 'One of our debt collectorw will be contacting you either at home or place of work to arrange payment in full'. They require payment ' in full by no later that April 8 2009' The letter was sent 2nd class post.
I still don't know how much of the amount is disputed charges and I still haven't had a letter confirming the hand over agreement. Any advice please?
I'd like to hear the answer to this. what do you do when you've got no statements, no breakdown and no idea of what the total debt is made up of?0 -
Hi all, I am sending out token payments this week. I have previously sent the CCCS DMP notification letter to my creditors. I have been looking for a token payment template letter to include with my £1 postal order but couldn't find one, so I have created this one using bits from other templates I found on the internet. Before I send it can someone have a read through to make sure its acceptable?

In view of my/our circumstances, would you please accept this token payment at present to be reviewed in six months. If interest or other charges are being added to the account, I/we would be grateful if you would freeze these so my/our debt does not increase.

Can you also send me any policy documents / information leaflets etc you produce for someone in my circumstances?

For an IVA your main interest does need to be in the UK. You would be better to have a telephone appointment with the CCCS so we can look at your options for you. To call from abroad it is a different number so I will PM you it.

I am a UK citizen living in Taiwan and am grappling with 17000 pounds worth of debts left in the UK.
Most important is an Egg loan that has been sold on to CapQuest, who are now adding interest.
I copy below my CCA received from them after my request.
Currently, I propose writing to them saying that I am taking debt advice, that will buy me 30 days grace. After that, I propose to contest the CCA using a template letter that I have.
This is on the grounds that the copy CCA sent to me does not include a 14 day cooling off period, and it refers to terms and conditions that were not sent with the CCA, which remains the two pages that you see below.
This again will stop further action and interest being added by CapQuest.
My aim is to try and negotiate a settlement with them, but the debt started as 2600 pounds and is now 4600 pounds, so they are trying to avoid a setttlement.
Any advice is welcome. Thanks in advance!

If you are offering any type of reduced payments then you would need to change accounts. HSBC would be able to dip into your account to bring your credit card up to date and this could leave your short for other priority bills.
All debts would also need to be included in a dmp, as the key thing is to treat all your creditors equally and not favour one debt over another.
When your budget is put together there should be a section called ‘repairs and maintenance’ you could add some money in here for household repairs. You can never budget for everything this would be impossible, so if one off costs do occur when on a dmp let your provider know so you can come to an arrangement for a month or so if necessary.I am a Debt Counsellor that works for the CCCS and have specific permission from Martin, to post on these boards to try and help those in debt. When offering reduced payments, you need to offer an amount that you can afford not what the creditors want.
Your payments on a dmp would go towards the balances on the accounts, however when the debts are passed to collection agencies they do tend to offer settlement figures to clear the accounts.

Hi,
Just got confirmation from CCCS that my DMP starts 01 July.
I spoke to an advisor at CCCS. Because my DMP starts on 01 july my creditors will get their next payment at the end of July. Obvioulsy I have some minimum payments that are due before that. CCCS told me to send the £1 token postal orders to those due. I asked if their was a covering letter template I could use, but apparently there isn't (previously sent the notification DMP letter from CCCS already). Does anyone on here have one? Advisor suggested creating own one but don't want to get it wrong.
It does not have to be too long. I would just put something along the lines of…

Hello,
