goernment help :mad: i am on employment support allowance and i have just been told that i am not entitled to mortgage interest help i have been waitng now 17 weeks the DWPtold me this over the phone my remortgage was taken out to pay for adaptions to cater for a disabiled young person with multi-plex disabilities and smoke damage any help

Did you receive a full explanation for why your claim was turned down? From the information you have provided it sounds like you meet the criteria for Support with Mortgage Interest payments.

HELP!!
I am in the middle of setting up a DMP with CCCS due to start on 1st June, I have sent letters to all my creditors with £1 token payments, and told them what is happening, I have just received a letter from Egg saying the following:
Despite our previous correspondence you have failed to provide us with any satisfactory proposals for repayment of the arrears on your account (one months payment) unless we hear from you in the next 48 hours, we will proceed with our collections procedures which will include the issue of a statutory default notice......and goes on to say how my credit rating will be affected etc.
What do I do? do I ring them? I have avoided speaking to anyone as yet! I know they got my letter & £1 postal order as they credited £1 to my account (and charged a £2 fee for doing so)...I thought they would at least wait to be contacted with the DMP offer before making these types of threats???Light Bulb Moment feb 2009

Dear cccs:
I received a letter from a dca about a debt that I am positive that it is more than 6 years old. It is not a joint debt,I have had no contact with this company or previous one for 6 years.
I gather it is under that rule but my question is what do I do about it?I have had another letter this morning,not threatening though.
Do I ignore it? I am not disputing it although had forgotten about it,think its at least 10 years ago.

Hi we have got £36000 of unsecure debt costing us about £600 a month and have to use the credit cards (all maxed out) to make ends meet each month, have been offered an IVA by Freeman jones for the amount of £289 pm, any views on this and of freeman jones, thanks

I would not be able to say if you are eligible for an IVA as I don’t have your full financial details; however I would recommend that you seek advice from a free independent organisation such as CAB, National Debtline or CCCS.

I contacted CCCS last year for help with my debts and I am currently paying £30 per month to 7 creditors. I was paying MBNA £8 per month which they said was too low. I received a letter yesterday from Lewis Debt Recovery saying the debt has been passed to CL Finance Limited. They are asking for the full amount of £3257 to be paid to them immediatley which I obviously cannot afford. I still want to keep making my £8 payments in the meantime rather than stop paying but am unsure as to how I should go about this. Should I make contact and if so what should I say?
Any help will be much appreciated.

This is nothing to be worried about, all you need to do is send CL Finance a new copy of your budget and stick to paying the £8 per month – even if they say that they are not accepting it.

I was not 100% sure of the answer, so double checked this with my colleague in Northern Ireland and this is her response.
This means that the debt has been taken to court and judgment gained. It then is enforced through the Enforcements Office (EJO), the EJO carry out a means assessment to establish what the client can afford to repay, if the clients cannot afford to repay back the debt, for example no income, no assets, a Cert of Unenforceability would be issued. This would be issued to the Creditor as well as the Debtor, the debt cannot be collected unless the clients circumstances improve.

My only concern with an IVA is that i owe around 78% of my money to one creditor so if they reject it then it cant go ahead.

I would recommend that you call our client support department as soon as possible and have a review. The most important thing is that you have enough money to cover your priority expenditure.
With regards the payments to your creditors, they can only have what is left over in your budget. During your review, your counsellor will look at all your options again and see what is your best advice as there maybe better suited options for you.

Hi bit of an usual situation. I've got £30,000 worth of debt and am looking at sorting this out throught the cccs. I have a joint mortgage with my partner who earns £42000 a year has no debts or credit cards (lucky fellow) the mortgage has never been in arrears and he could afford to pay the mortagae on his own if needed. However if I go down the DMP route my credit score will obviously be affected so he is worried if we want to move within the next 10 years and we put in for a joint mortgage again even if he could technically afford to pay all of the mortgage would they turn us down because of my DMP? Thanks for your help. (we're not married - didn't know if that makes a difference?)

If you were on a debt management this would have some effect your credit file. For example you would be offering reduced payments so this could result in default notices and the creditor would have the option to pursue you for a County Court Judgment.
With regards applying for a new mortgage, as you would be classed as a higher risk to the lender they may charge you a higher rate of interest. So this would mean you would have to search harder for a better deal.
You would be more than welcome to have an appointment and a chat with a debt counsellor and they will look into your options for you. If a debt management plan was an option for you then you would be sent all the details to read over, if you chose to not go ahead with the plan you would just need to let us know.

Hi,
I have 2 credit cards which I am really struggling to pay minimum amounts on. I recently wrote a Credit card cheque (in a moment of weakness) and not for a huge amount but since then my Mum told me that I could request the card companies stop interest on my balance. Could I do this even though I have an outstanding cheque with them?

You would be able to ask them to consider stopping the interest and charges. If you write them a letter explaining that you are in financial difficulties and give them a copy of your income and expenditure.
Creditors are under no obligation to stop the interest and charges, so if they say they won’t stop them. Work out a reduced payment that you can afford and send that to them.

Hiya,
A default notice is standard procedure; you don’t need to contact them. Just make them token payments until your plan is up and running.
A default notice is a legal requirement that ends the contract between you and them. So now they could choose to pass the debt on to a collection agency. If they do transfer the debt then let CCCS know and then we will change who we are paying.
