Ebay are saying my DVDs are fake, but they are not?

Options
I have my listing pulled twice now, by ebay, becaus ethey are saying i am trying to sell counterfeit DVDS? How do you go about proving that they are not fake? I have put up pics of teh box, the DVD itself so you can the see the printing on it etc. Is there anything else i can do? A lot of other people are selling the same DVD box set as me, and dont seem to have a problem. So what am i doing wrong?

Are they being pulled under VERO rules, or does it categorically state "fake"?

If it says fake, then it's likely to be somebody pushing the report button on you, so it will take a few emails back and forth with the trained chimps in customer support before it is resolved.

If it is VERO, then it is becasue the copyright owner or DVD distributor does not want their product to be sold on eBay. A lot of music DVD's are pulled under VERO, particularly anything by BMG, and Paul McKenna is an absolute donkey to deal with if you try selling one of his DVD's on eBay.

  • No mention of Vero at all. Its a disney boxset. The first listing was pulled within 5 minutes of it being listed, with only 1 person viewing it. The 2nd listing lasted a day before being pulled. I emailed ebay help, but just got back a standard response saying that they are cracking down on counterfeit DVDs. It said i have to verify that it was real, by putting in as much detail as possible. I couldnt have added any more info about it!
  • "Your listing was removed because it breached eBay's Prohibited,
Questionable & Infringing Items policy which you can read by copying
this link into a new browser window:

    http://pages.ebay.co.uk/help/policies/replica-counterfeit.html

It's against the law to sell counterfeit items, unauthorised replicas
and unauthorised copies, so we don't permit them to be listed on eBay.
This helps protect buyers from purchasing unauthorised, counterfeit or
fraudulent items, and helps intellectual property rights owners protect
    their rights.

While listing the items, generally what we suggest to the members is to
enter the sufficient information about the listings on the description
page, provide clear and sufficient pictures, so that the bidders are
able to get the idea about the item they are willing to purchase. I'm
afraid we can't give you any more details about why we removed your
listing. However, please let me assure you that before we remove a
listing, we examine it carefully and we don't remove it unless we're
certain that it breaches our policies or User Agreement, or we believe
it breaches UK law. When we removed your listing we also credited all
associated fees to your account. "

I've had this happen lately and my ebay account has been suspended because of it so go carefully when relisting.

I was trying to sell a couple of boxsets of The Wire - followed ebay instructions to verify their non-fakeness ie actual photo of the item as opposed to stock photo, as much description as possible etc, but the listings kept getting pulled. Now I am not able to sell anything at all from my account!

I would suggest leaving it for a few weeks and then trying again, as nothing I did to my ad seemed good enough and I just kept getting the same formulaic email from cs when I complained.

  • Is there any other way of contacting Ebay? they are taking about 2 days to respond to my emails.

What I dont get is that there are many other sellers selling the EXACT same thing as me, why arent they being pulled? Ive gone through their listing to see if i was missing anything, and in some cases I actually have more information in mine?

Have you filled in all of the specifics - that is all of them. This is how you can tell the difference between them being fake and real to be honest.

    This has no specifics:

    http://cgi.ebay.co.uk/Disney-Pixar-Cars-DVD_W0QQitemZ300267537435QQcmdZViewItem?hash=item300267537435&_trkparms=39%3A1%7C66%3A2%7C65%3A10%7C240%3A1318&_trksid=p3286.c0.m14

    This one does have:
    http://cgi.ebay.co.uk/Cars-DVD-Walt-Disney-Genuine-hologram-dvd-Pixar_W0QQitemZ120320910302QQcmdZViewItem?hash=item120320910302&_trkparms=39%3A1%7C66%3A2%7C65%3A10%7C240%3A1318&_trksid=p3286.c0.m14

Get everything filled in, you'll find details on the box and I think it automatically fills them in.

    Then you should be fine.

  • Blue monkey - thaks for that. But the 2nd time i tried listing it, i did that? Filled in the number & got all those details. And none of teh other identical sets to mine have even bothered doing that.

Would there be a reason why ebay are picking up on mine, but not anyone elses?

No that I can think of. Ebay seem to want who they want to sell these days. It could be some competitor reporting you. That is why i do not bother anymore.

When I started out many many moons ago someone told me to put keywords in white at the bottom of my listing - this was in the very early days - so I did and for years just used the same template over and over and I had thousands of listings on the same template. Anyway, one day I suddenly got 'end notices' for about 20 items. I could not figure why. Then I got another 20 ended, and another 20. Then another 20 and a suspension, it was only after emailing that they told me the words that I realised what it was and I remembered they were on there. The thing was that they were totally irrelivant keywords as my ranges had changed!! I spent weeks getting rid of the old listings and relisting the stuff again. But on one particular day I got 80 listings ends, clearly someone was gong through my things and picking up on the words and reporting them all. I did wonder at that time why some people had nothing else to do as I was in the middle of doing them. I put it down to competitors not having any sales mind!! I'd certainly not have the time to go through peoples listings.

I do not know. The thing is, if it keeps on getting pulled you'll end up with a temporary suspension. Can you not sell it on Amazon or Play? you'll probably have more luck.

I had no end to problems trying to sell genuine region 1 disney dvds.

Disney are up there with BMG and Arcadia when it comes to strict VERO enforcement. Even though the DVD's may have been genuine, the region coding means they should only be sold in the Northern USA & Canada marketplace. Listing them on the UK site goes against the agreement that Disney have with their UK distribution network.

However, if you do have a distribution deal with Disney in the UK (either through Miramax or Entuk), they do not seem to mind you selling Region 1 alongside the Region 2 discs....

This is just one of many examples of how fraught the DVD selling game is on eBay, and why more and more of us have moved out of the game. Gowingstore, Retrowarez etc are both very well tied up with the main UK DVD distributors, making it difficult for anyone else to compete long term.
