Parking in disabled bay
Hi all,
Recently i started a new job and smashed my finger on my second day there!, on the thursday i had an appointment at the hospital to have an operation and i was also at work the same morning, i got away a bit late and rushed into town to catch my appointment, along side the hospital there is a whole road full on one side of parking bays, i drove up the road and found a spot right next to a parking meter which i thought was great as i was running late. I bought an all day ticket as i did not know how long i would be in the hospital i think it cost me about £8 and stuck it in the window, later that afternoon i returned to my car to find a ticket on my windscreen!, i promptly rang the number on the ticket and the woman asked me where ir it was richardson road where i got the ticket immediately!, that was the road i was on. She then informed me that the ticket was for parking in a disabled space and that alot of people had been charged for this. I looked around the area where my car was and could find no obvious road marking or sign to say that the space i was in was disabled i explained this to the woman and she agreed and told me to write a letter to them explaining this. Which i did. I recieved a reply with various pictures of my car and the parking meter directly in the backround and also a tiny sign with two arrows on it, one arrow to the left said disabled free and something about a fixed penalty but nothing obvious to say i couldnt park there with a ticket, and to the right pay and display. Obviously i had parked directly to the left of the meter. The letter from them basically said tuff! and that i would have to pay the charge which i dont think i should have to, i now have a court summons for thursday coming and i would like to know what chances i'd have if i fought this, after all the sign above the pay and display saying pay here is massive, but the sign to say you'll be charged if you park in certain bays is absolutely tiny.
Any help would be gratefully appreciated.
Thanks in advance
Joseph

after all the sign above the pay and display saying pay here is massive, but the sign to say you'll be charged if you park in certain bays is absolutely tiny.:A Luke 6:38 :AThe above post is either from personal experience or is my opinion based on the person God has made me and the way I understand things. Is this a council or a private parkig company that you are dealing with?0

This site: http://www.ticketfighter.co.uk/parking.htm#parkingbays states that disabled bays need to have the word DISABLED painted on the road. If they don't, then the restriction is invalid and you cannot be fined.

What was the exact wording of the sign? Can you post a picture of it?
If the woman on the phone said that they'd fined many people for parking there, then that would hint that the sign is unclear and thus unfair.
Personally I'd take it up with the local paper too, as if they're going to fine people for parking in disabled bay, then they should clearly mark them and make it clear that it's for blue badge holders only!Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -

hi thanks for your reply, i'll try and get a photo on here later with the exact wording but honestly there is a massive post and a tiny square at the top of it with what i feel really unclear instructions about parking there, it doesn't say disabled permit holders only, only say's disabled free and then details of a fixed penalty. but doesn't say you cant park there with a ticket0 -
See my revised earlier post. I don't think your ticket is enforceable.0
