Words of Wisdom please. anyone
I am still doing the form!
I took advice from Payplan when the IVA failed on the phone in June and they put me through to the Bankruptcy guy, he gave me advice is this going to be enough for the judge? or do I need to phone debtline tomorrow in Court on Wednesday have tried a few times but never got through.
I think I can reply to the questions, as was in the IVA so know NO credit, overdraft cheque book, director of company, any thoughts please. Just another thought going round in my sorry state for a brain. Some Days are Diamonds Some Days are Stones,Sometimes the hard times won't leave meBSC 162:beer:Banktupt 22 Oct 2008 at 10am!0 -
Rylynn don't worry if you don't know what you spent your loans on etc tell them what you can remember and it sounds as if you were increasing it possibly to consolidate? But just tell them what you remember. I pride myself and being able to recall every detail of what I spent. Its all kept up in my head but could I remember anything in the OR interview - NO. I couldn't believe it my mind went blank. I do now remember though! OR told me don't worry.
About the amounts etc. I would suggest you put a rough estimate and when you have your OR interview explain that since your IVA you don't really know what amounts they really are -I'm sure if the OR wants to find out he can.
I can't stress enough that this really is the hard part. Once (if!) you fall asleep tonight the rest is a breeze. If you spoke to payplan that should be sufficient to say you've taken advice (you've also had our advice!). I wasn't asked that question anyway. They don't check who or what the advice was.
Good luck, you just have today to get through. Be sure you have plenty of printer ink and paper to print on.

Oh FTP you make me smile which is good. I have caught some virus off my mum so very pleased now I booked today off as well.
These online forms do not allow you much room to put anything, ie in what was it for, you only get to type so many letters, so I put holiday paying off OH (ex now) debts and it would not allow me anymore explanation! Now do I add something on blank paper to explain more? I dont want to waffle as you all say not to.
I can remember some of it FYP, and you are right this morning I thought, right that original loan in 1998 was for £5k and now shows as 11,990k so at some point I paid one off and had some more money that Barclays so kindly threw at me! Oddly I did not apply to Barclays for any loans, overdrafts or cards they offered them all to me! AND YES I should have said NO! Hindsight is a wonderful thing! Crystal balls would be much better though!
Thanks for your words of wisdom, just one more sleep, I am so pleased it is 9am at first I was like OH GOD that early, it is an appointment so I hope not to sit for hours, but whatever I just want this over now. Will have a book, drink and cigarrettes as I will need one after the event.
Thanks also for the advice on taking advice Dalip also said as long as I have taken it and can say from whom in case they ask, and he was the bankruptcy person and I do have his full name if needed.
Does the judge ask you lots of questions, never thought to even ask that, god I will be quaking in my boots, I typed that as quacking!! but I am not a DUCK!!!
On Paper have heaps of it, on ink have to hope it lasts the 60 pages is it okay to have it one sided my printer wont print two sided! eek never thought of that either.
Tesco sell the ink so will go there if needbe, and any hiccups I have the blank hard copies all ten of them!! just in case.
You have all been wonderful and my mum aged 74 said without this site she thinks I would have cracked up by now and she is right. Even just to come and read other peoples things and help them where I can, or have a smile at a joke or two all helps on this long road to BR.
Rylynn
any help on the above would be appreciated.. nearly there now.
OH how much detail did you all go into on how you got into debt? it is such a hard one to even begin to start, as there is personal things that can be said like being beaten to a pulp which is why I let him leave and end up in the mess. Just not sure what to put. I so hope the company with the joint loan go after him for it! if they can find him that is.Some Days are Diamonds Some Days are Stones,Sometimes the hard times won't leave meBSC 162:beer:Banktupt 22 Oct 2008 at 10am!0 -
Rylynn,
I think there's a limit to how many characters you can use in that section of the online forms, wherediditallgo definitely mentions this in one thread if you've got time to go digging. Billy and I tried for "factual but with a touch of enlightened regret", if that makes any sense. ie, fall in income due to the break up of a relationship, compounded by rising interest rates etc. Good luck tomorrow.

I remember writing mine all out, basically explaining as factually as possible how things happened, when I realised I couldn't pay stuff back. Think it was roughly 500 words but not sure... hang on..Get free advice before embarking on bankruptcy: CCCS 0800 138 1111 National Debtline 0808 808 4000

Thank you Lily, I have to say yours was the very first thread I was sent to read here by my wonderful friend in June. She knew I was really crumbling under all the pressure of the IVA failing and had no way to pay the debts that would all fall back in my lap. In 2005 I thought that was it, 5 years all over, however no one told me that I would fall so ill and it fail.
If anyone can answer my other questions above I would appreciate it.
Will go and dig out wheredid it all goes threads. I am contemplating hand writing this but I have problems with writing and it will take a long time, so hope to get this online form to work for me. Just rang the court to confirm I am booked in having read another poster here saying she phoned and was not! that would have done me in! From what the lady has said I will most definately see a judge and the OR will speak to me after that on the phone, and in the notes received it says he will ask me about debts and assets.
Anyone know if you can print off more than one copy of this online form??? sorry just my head is all over the place right now! Some Days are Diamonds Some Days are Stones,Sometimes the hard times won't leave meBSC 162:beer:Banktupt 22 Oct 2008 at 10am!0 -
Here was my essay:Merry_Gentry wrote: »Cause of Bankruptcy
After my last daughter was born, I returned to work on a part-time basis. We calculated that childcare costs would mean working full-time was out of the question, and that my husband should be able to meet a higher percentage of our cost of living expenses. Due to what was deemed as his high level of income, I was not eligible for various tax credits as the assumption was that my husband would be assisting me financially.
This was not always possible (he is paying through the CSA for his daughter from a previous marriage), and it reached the point where he could not meet his share of the mortgage and childcare commitments. We re-mortgaged the house to settle a number of these debts, bringing the mortgage to £180,000 and mortgage payment to £1095 per month. My husband, unbeknown to me, was having to resort to using his credit cards again. I was subsidising our income selling a diet product, and the hope was this would grow to cover more of our costs. I used the money from this to pay for food, general living expenses and clothing for the family. I completed my tax return and found I had to pay £3,000. Having used the money that would have gone on the tax bill to feed/clothe the family, I had no choice but to sell my car and use a credit card cheque to cover the remainder of the tax bill.
Following marriage difficulties, we discussed a temporary separation, which is when my husband revealed the details of his financial state. At this point we sought professional advice from both CCCS and the Insolvency Department, who recommended bankruptcy for both of us.Get free advice before embarking on bankruptcy: CCCS 0800 138 1111 National Debtline 0808 808 4000

Merry's hit the tone perfectly, Rylynn. You need to relate the facts, in the relevant order, and try to imply that you're aware that it's a mess (otherwise why would anyone put themselves through this, duh!) and have made every effort to address the problems. Basically, the clearer a picture of your history that you can give on the form, the simpler it will be for the OR to do their job. Don't worry, it will be fine.

Thank you Merry, when I have completed mine I will post it up as maybe these will help other people. It is the hard bit on the form for me, hence keep putting it off. Have done most of the rest just got to finish adding the creditors and who now owns the debts, which is a muddle from the IVA people.
Can any one tell me what the allow for ONE child as an after school activity please as I would like to add this to my SOA. He should not have to suffer for my mistakes so think allowing him to go swimming or the cinema once a week should not be frowned on I hope.
Many thanks to you all, I am doubling checking the forms now, and then have the creditors bit to sort out due to 1 loan and overdraft now showing as one creditor when initially for the IVA it was 2, it has been bought by MAX somebody and they have made it one item! bliss this is not! Some Days are Diamonds Some Days are Stones,Sometimes the hard times won't leave meBSC 162:beer:Banktupt 22 Oct 2008 at 10am!0 -
Rylynn, I think we put £12 down for the after-school activity for our boy. I thought that all of our figures had been accepted as the IPAs for both of us were exactly as I'd calculated them. However, the OR mentioned in passing the other day that our transport costs were higher than their guidelines - this was when I phoned to ask whether we could reduce the IPA to reflect the massive car repairs we had just had to deal with (answer: no) - so it may be that some figures were adjusted downwards and others were adjusted upwards. It would be useful to know how the IPAs were calculated, in case we have to do another set, but I've yet to pluck up courage to ask.
