Can I get my deposit back

Hi Everyone,

I hope someone can help with this one.

On the weekend we put a deposit down on a car from Evans Halshaw and were told that the car we were buying had fsh and still had a years warranty. However, it's looking increasingly unlikely that they will be able to provide any proof of service history and we therefore will not be happy with this car.

Could somebody please confirm that we are entitled to our deposit back. We feel we have been missold the car.

    Not sure about the deposit but theres a text check service which gives you make and model, Chassis Number, engine size, first registered date, the number of owners and indications if the vehicle has been scrapped or stolen. You text with the reg number of the car and they will send you back the information if available. Costs about a fiver, will find the link to the site if you're interested.

    Had trouble with carnation many moons ago, They wouldn't give me a refund on a dep.

    So, I subbed a local 'Hardman' a 20 to Go and 'Knock the C**t out'

    He didn't have to use his renowned violence - They handed the money back no trouble.

    If you relied on information before paying and this information is now incorrect you are entitled to your deposit back. Unfortunately proving what was said could be difficult. If the car is advertised as having a FSH this is ample proof and is miselling.

    Evans Halshaw took over a lot of Dixons outlets - different name, same reputation.

    I've HPi'd the car so there's no need for that. My only current issue with them is that they can't find the proof of service history.

    Thats what I'm worried about. The adverts are no longer stickered up on the car as he pulled them off when we were there to test drive it. But he did say it had been serviced twice and has a years warranty remaining on it and I called and spoke to a different salesman yesterday who said the same, but as far as I'm concerned, if they can't prove the service history then it's no good to me.

    Most car manufacturers run a data base with all servicing etc. Surely its on that? If not then demand your deposit back.

    In my experience, most manufacturors do not keep a data base of all services carried out. Individual franchises keep history of services done at their garages but nothing more. Warranty work tends to be on a data base as the manufacturer has to pay.

    I'm gonna try my best to get my deposit back today if they can't come up with the goods. I'm just not going to leave the showroom until I get it back.

    Well...the salesman said we could have our deposit back but then the MD called and said they're looking for the service history. They said if they don't find it they will service it and give us 2 years warranty with them. I dunno if I trust them though. I don't want to be messed around for the next 2 years and end up with faults unresloved.

    If they can't prove it had its services on time then the manufacturers warranty is probably void. I'd be demanding the deposit back - I doubt the warranty they give you will be as good as the manufacturer-backed one, even if it does last two years.
