Definitely not negative unless you are sure it isnt stolen (i.e. a relisting)... id say a neutral is fair2 + 2 = 4

Id not leave any feedback and keep and eye on the seller. If he then puts another auction up for the same phone, id then leave him negative saying that what he has done.
Unfortunately sellers do this a lot. I was watching an item last week which went for £10. Normal price was £100. I was anoyed i missed out on it, but was happy when I then noticed a few days later that the seller got a negative for refusing to sell the item to the lucky winner. The seller then re-listed the same item again and this time only got £20 for it, as he by then had several negative feedbacks!0 -

Thanks guys for all your useful comments. I am going to focus on finding a new phone and hold off doing anything about this one for a couple of weeks. If the phone really was stolen then I don't think its fair to punish the seller further especially as he dealt with the refund so quickly. If he relists it though i'm going to be mad(!!) and will definitely leave feed back so that others know what has happened.0

If he's left it in his office who fault is it? and who the hell stole it? A co-worker? I doubt it. things dont just get 'stolen' from offices theres a thing called security that people have to get past first. If it was someone who worked at the office then the seller needs to make some serious enqiueries. Hi where do you work?? I work in Central London theres things going missing in our offices all the time. When you work in a big compay you have different people come and go all the time.0 -

We used to get things stolen from our office (in a university department) quite frequently. The problem with a university is that you can't lock all the doors to the department, but people forget to lock office doors.0 -
I'd leave a positive saying "refunded me promptly after the xxxxx phone was stolen before postage" or similar.Happy chappy0

Can the buyer take the seller to court for failing to fulfil his side of a contract? This is if he does relist the item0
