30 day notice with 3?

I have been with 3 for 12 months and had so many problems with dropped calls and poor service, I decided to switch to O2. My contract was due to end on 24th November, so on 24th October I rang 3 to give them the required 30 days notice. After a hard sell they asked if I would like to port my number to O2, which I said I would. They said to ring back within 72 hours when the PAC code would be ready. I tried to ring up a few times and kept getting cut off and put on hold etc. In the end I decided to leave it and not take the PAC code, and assumed my contract would automatically end on 24th November.

I have now received a bill from 3 for another £30 for line rental until 24th December! I have rang them, and they said that because I didn't port the number over, they have assumed I wanted to stay so have to pay another month. I never even got the PAC code in the first place, and they say that it has expired now. They said I have to give another 30 days notice now! Can they do this when I have paid all my 12 month contract? I did give them the required 30 days notice so do you think they are trying it on? After 12 months surely the contract should automatically end? I have cancelled my direct debit now anyway.

Can I get away with not paying it and sending a snotty letter, or do I have to pay it?

    If you request a PAC code, this lasts for 30 days and as soon you've transferred your number to a different network, your contract with '3' will THEN be finished. Because you didn't do this, the PAC code would have expired after 30 days and your contract did not end.

    On the other hand, if you give 30 days notice to leave them, then, yes, your contract WILL be finished after the 30 days.

    My friend had this same problem with Orange and learnt the hard way!!
  • I'm also leaving "3" and have obtained my PAC code relatively painlessly.

    But just to clarify gaahmad's last posting

    from the "3" "Guide to transferring your mobile number"

    "the issuing of any PAC against a mobile number will revoke any previous disconnection request".

    So, it appears to me, if you write a letter to disconnect, THEN ask for a PAC and then DO NOT use the PAC you remain connected with "3".


    I believe this is standard with all of the networks and not unique to "3".
