They can take the details over the phone, then send you the completed paperwork to review, sign and return.
The more information you can provide to support your claim the better, so send them a copy of the sales receipt, valuation, expert opinion etc.
It isn't a quick process, unfortunately. My claim took around six months, but came out in my favour with the card company refunding my money.0 -
We have ordered wedding bands to be specially made for us from a company that I won't name, however, in order to shape one of the rings they needed the engagement ring. To cut a long story short, they basically sent the ring back damaged and are refusing to take liability... :mad:
Is there any protection from the credit card company for this? i.e. can we get a refund for the deposit and subsequent payments and in effect cancel the contract based on this damage?
We'll still have to pay for the repairs, but if we can get a refund of the contract monies paid already then we can concentrate on getting our ring fixed

I bought some car seat covers online that were poor quality and I therefore returned, requesting a refund. The trader, Climax Car Seat Covers - has anyone dealt with them? - is trying to avoid this by saying their terms and conditions state refunds will not be given for custom-made goods. However the whole organisation has been set up to produce custom-fit - rather custom-made - seat covers and the OFT say the Regs cannot be overridden in this way, although I assume, if the trader refuses a refund, my only recourse is to take court action.
I also contacted my credit company who have been very helpful and are prepared to pursue the trader, although I now see that delivery has to be deducted from the total cost which would result in it being just under £100. The other approach they suggest is to bring in an independent expert to advise on the quality of the goods, but this doesn't seem worth pursuing for the amount involved.
Advice would be appreciated.0 -
Hi, I paid a £250 security deposit on a flat for my friend, on my credit card, and when the tenant left, the money was refunded by cheque to the tenant. However, I no longer have contact with the tenant so cannot obtain the money from him. However, shouldn't the money have been refunded to my credit card? Should my claim be with the company to whom I paid the deposit or can my credit card company help?
Any ideas anyone? Thanks0 -

You have no claim on the card company. You might have a claim on the company administering the flat if you had a contract with them but I am assuming from your post that you do not. I made a purchase of a registration plate from a small trader on my credit card and used Paypal to pay. I never received the plate and I could not get proper contact from the seller. Eventually, it transpired that they resold the goods (the registration plate) to another person a couple of months on and after that went bankrupt.
Do I have any rights under section 75 or will I hit a stumbling block having used Paypal to pay them with the card?0 -
I purchased flights with Ebookers in July last year and paid using my Nationwide credit card, this was done as one single transaction for £137.29, these flight then got cancelled with Ebookers saying that the only option was to have the money refunded with 6 weeks. I agreed to this and went back on ebookers ad booked new flights at a cost of £460.66.
Since this happened I have tried to get the money refunded but so far have only had £19.29 from Ebookers as that was the booking fee, I have had no luck with ebookers getting the rest as they say it has to come from the airline!
I decided to try and recover the lost money through my credit card provider under section 75. I have today recieved a letter from Nationwide informing me that I have no rights under section 75 as the booking was done as 3 transaction £19.29 to Ebookers and 2 single transactions to Han Air for the flights.
They have aslo informed me that i have no write for a claim under there Dispute Claims Process as to much time has elapsed since the flights got cancelled.

I booked a hotel in december for a stay in May through Hotels.com. The booking confirmation shows 3 twin rooms which is what I wanted. However, after requesting confirmation from the hotel, they told me I only have two twin rooms and a double (which I dont want). The hotel claim it is not their fault and Hotels.com are sayng the same thing. Neither are giving me a refund. Can I claim this back? The whole thing was paid using AMEX. Would I also be entitled to any compensation for any additional costs I may incurr as a result of prices going up?0 -
:jin 0ct 2007 while on hols in Cyprus, i joined Freedom Vacation Network with my partner. it was supposed to give us great discounts on worldwide hols, hotels, flights etc with the promise that after 5yrs of paying an annual fee we could claim back the original membership fee of around £8000. on this basis we joined but have not used the scheme due to illness etc. we have written to the cashback company but havent got a reply. recently we have been inundated by cold calls from a variety of companies offering to chase our money on the basis that FVC is part of Timelinx which is owned by Incentive Leisure Group which has apparently gone into liquidation. we paid a deposit and the bulk by bank draft. every company has sounded 'dodgy' but we want to get the £8000 back if poss. can we claim using sec75. it appears Timelinx is/was based in Spain while we purchased from Cyprus. is this a problem? i read there's a 6 year cut off we are just inside that. any advice would be good.0

Whilst in Spain in February 2009 my partner and I were sold a similar product by Thomas Consulting, an agent for vacation holidays/Timelinx. The promise was for very cheap holidays and flights for 25 years as long as we paid an administration amount each year of £75. The cost was nearly £6000 and at the time we thought a good idea. We purchased the product by paying the deposit on a credit card and the rest by bank transfer. When we returned home we tried to book these holidays and found out they were no cheaper than we could find elsewhere on the net. We tried to cancel our agreement, without success, so I tried my credit card under section 75. I was told at this time I could not claim as they were a 3rd party. I thought no more of it until before christmas I was contacted by a legal firm from Spain saying that they could get my money back if I sent a cheque for £500. I was very wary of sending any money as I researched on line that these could also be a con. The lady I spoke to was very nice and said I could do this myself and told me what to do. So I wrote to the credit card company myself and to my surprise they sent a letter back offering my deposit back. I rang them and said I thought I was due the whole amount back and they said that if I sent them paperwork showing the full amount they would look into this. I duly sent the paperwork off and to my surprise they sent a letter back saying they would credit my account with the full amount I had paid out.0
