Two points the credit company would have a responsibility to the original purchaser not to you irrespective of him transferring the contract and whilst there is nothing in the consumer credit act giving a time limit the Limitation Act would seem to apply which gives 6 years.

Does section 75 also cover purchases on pre-pay credit cards?
I.e. I have a caxton fx mastercard that I "load" before I go on holiday. I buy an item abroad costing over £100 (equiv.)

Pre payment cards do NOT fall under Section 75 of the Consumer Credit Act therefore you are not covered. hello, i bought a tv 2 weeks ago, as i opened the box some thing rattled around and remote was over resonsive, so i rang then up and they aranged to pick it up and take it back,sent another tv,this was also faulty? sent back again?
do i have to take another tv, or do i insist on a refund? comany said they have to prove tv is faulty before they do any thing

I was wondering if someone could help me in relation to using Section 75 on a new car.
I bought the car 1 yr and 1 wk ago. It was a new car from Hyundai. After 7 months the wipers stopped working. It has happened 4 times since then and each time they tell me its "definiately fixed". Obviously its not as it keeps happening. Its only done 4000miles.
Im going to write to the dealer and try and reject the car and receive a full (Hopefully) refund. If they dont agree to this, what rights do I have with the credit card company ? I paid the deposit (£500) on my credit card and paid the remainder with my debit card.
All help would be much appreciated.0 -

You cannot reject the car after so long, but Hyundai should put the fault right.
You have the same rights against the CC as you have against Hyundai, it does not matter that you only put £500. using the card,(it could have been just £1.), the CC company are liable for the whole transaction.

What do I do to involve them then ? just ring up the customer services? or write a letter. just not sure what to write to the CC
Start with Hyundai and take it from there, you can copy to CC informing them there might be a S75 claim coming along, at least they will be in the loop if Hyundai don't play ball.
