A year ago (August 20) I got married. I paid £1250 on a credit card for a wedding photography package. The photographer turned up and took the pictures. We received a CD of the pictures taken on the day, but the package included a bunch of other items including a canvas, photo albums and coffee table books etc which we have not received. Despite numerous protestations (phone calls, lettes, emails) to the company, the items have not been forthcoming - we have been told that they are on their way for months. It has now been a year and I believe that I have allowed reasonable time for the photo company to get its act together.
I eventually turned to my credit card company to reclaim the money. After some hassle, the credit card company is looking into it. Rather than simply refunding the money, the credit card company is trying to negotiate with the company to get the items sent to me. I have tried this for a year - but I guess I am the small man on the street!
I am worried that the photography company will send a substandard product to me to get the credit card company off his back. I have lost all faith in the photography company and do not trust them to deliver a quality product as promised. I just want the money back so I can pay for the photgraphs on the CD to be put into an album by someone else. Is it possible to force the credit card company to give me my money back rather than receive a substandard product (a year late)from the photography company which will then render the matter closed?
Any advice would be great.

my situation is very similar to raviayer and I was told yesterday by my credit card company that they would use their charges back and disputes department to claim back though the retailer. As they prefer to do this before going through the section 75 procedure!
Surely after I've spent two months trying to get my dispute resolved with the retailer they should be doing as I've kindly requested in my letter (using the template letter from MSE) and refund me?
I also phoned consumer direct and they advised I send more recorded letters to the credit card company and the retailer!
Can anyone please tell me if there is a point where those liable under section 75 have to have resolved the situation and paid the refund? As by the looks of other peoples experiences this can be a very long stressful time with no definite end point.0 -
Has anyone any experience of using section 75 to resolve the usual issues of timeshare ownership?. We bought into the Club Greece scheme using a credit card a few years ago and suprise suprise, the Timeshare doesnt do what its supposed to do. One source has advised trying this route but having registered a complaint with Shell RBS customer services in June 2010, we have heard nothing.0

Hi - my partner was on the red driver training course - the automation barclays loan of £3500 kicked in and rather than paying their interest reates he paid it off on his 0% credit card with Egg - due to barclays pulling the plug and red going under can he claim a refund of the £3500 from Egg?

You might struggle with Egg! as the original transaction wasn't on your card, rather a balance transfer to the Barclays Loan.
......... but if it was a Barclays loan that you paid off there is no reason you couldn't claim against Barclays (Section 75 laibility exists on teh loan even though you've paid off, although you may need to make a formal complaint to get them to acknowledge it.)0 -

I paid some money (via my credit cards) a few months ago into a network marketing service that was supposed to provide me with regular income via their investment services. The company has since ceased trading - problems with the FSA. I put about £5000 into the service via my credit card, and another £2000 directly through my bank. As I understand it I can claim the £5000 through Section 75 of the consumer credit act, but I'm also wondering if I can claim the extra £2000 I placed directly with the company - isn't this a bit like when you pay a deposit for a car through credit card, but not the rest?
Also if it is possible to claim back costs, does this include the interest I have been paying on the £5000 on the credit card?
Any helpful suggestions?

I bought a TV from a website (3pins.co.uk, dont use it!) for £489 on a Tuesday, they took the money from my card on the Wed. I paid using my credit card. I didnt receive the telly after the time period, so they gave me an upgrade for an extra £60 to a different TV, which i bought.
Now, the website said, and the sales person said that the upgraded TV had a headphone socket. When i got it home and started assembling it, it didnt have one. So ive returned the TV to the Wharehouse and asked for some form of documentation to acknowledge this.
This is where i get nervous, they said they couldnt refund me straight away on my card. Its only happened today, so just wondering, if they dont return my money can I use Section to get it back?

Hi, i'm now on my 3rd Iphone in the last 8 months as they keep going wrong. This is very time consuming and basically I just want a phone that works. It's ok getting a new phone every time but i'm now getting sick of it. When I asked about a refund they said they could only exchange. What does anyone think or maybe this is something I can claim back under S75. I'm back into the shop this week as the phones broke again, so assuming they will offer me another new one, i want my money back instead. Can anyone offer any advice.
Forgot to mention I originally bought the phone on my visa card and paid £440

I have recently bought 2 pairs of ugg boots from china when they assived they were very shoddy and very bad fakes. I have tried to get them to give me their assredd so i can send them back for a refund. they keep stalling and have now offered me £20 to keep the boots as i paid £120 this is not good enough, they say the boots may get lost in transit and will cost alot to send can anyone help0

As you will know Protectacote have gone bust. This leves me with a20 year grantee that is not enforceable. The original coating was put on 18 years ago by the previous owner who I'm still in contact with.
I have writern to GE Money to say I want to make a claim under section 75 of consumer Credit act. They have writern back saying I cant.
My thinking is they are wrong, and just trying it on, because the guarantee was sold as transferable, and was transfered to me then the responsibility for the guarantee is still with them.
I'm happy to issue small claims if I need to, basically will I win ?
