  • i brought a car on my credit card and after less than a weel my front brakes failed and the back brake cylinders needed changing as they were leaking onto the brakes.
    on the garage taking the car for a brake test they imformed me the car was mis-firing i then had to get a service and new spark plugs which broke to to them being so decayed so it was not an easy job and cost me much more than it should of.
    the garage says they didnt sell the car with any warrenty so touch basically but they never offered me one also the car had passed its mot the day before i purchased ?
    i have only just passed my test and this is my 1st car what are my rights on my credit card ?? what can i claim

    For a start, the garage should have sold the car "as merchantable quality and fit for purpose" whether he offered a guarantee or not UNLESS he specifically said "Oh by the way it's not been serviced for ages and the brakes need doing" which I doubt. Go back to him and ask for your money back or you will go to the Motor Agents federation. Another thing that needs to be addressed is the M.O.T Testing station that did the car. You must get in touch with the relevant government dept to report this miscreant. Details are on the M.O.T. certificate. He may get try to get out of it by saying "It was alright at the time I tested it" Then you say O.K, I will take it to a proper station and see what they say. But given your info so far I would be inclined to say "money back or else". You only had it a week and all these things went wrong. I think you've got yourself a lemon.
    Any car that has corroded spark plugs like that , hasn't been serviced properly anyway. If that fails, check your local Citizens Advice Bureau.

    If you bought a car from a garage, then they're obliged to sell you something that's fit for purpose. This clearly isn't, so your first port of call should be with the garage.     The credit card company is liable under Section 75 here though (assuming the price is between £100 and £30,000, etc.). Thus, to get your money back, you have two options: keep pursuing the garage, or take it up with the credit card company.

    Personally I'd keep on at the garage until the next action you have with them would be to take it to small claims, then try to get the money back off the credit card company instead.

  • Hi, I am struggling to find out any relevant info anywhere and think Section 75 might be the option.
    My girlfriend booked a hotel just outside Disneyland Paris and the eurostar for a xmas pressie for her neices just before xmas. Unfortunately they were due to travel o the Sunday of the weekend of Eurostar's fun and games in the tunnel!. as there was no way to travel to France before the wednesday( their departure date from France), the trip hasd to be cancelled. Eurostar obviously refunded straight away, but as hotel was cancelled on the day of departure, she was charged their cancelletion fee of a nights stay £160. She does have travel insurance which she has to pay an excess of £60, She contacted HSBC(credit card used to book) but cannot get a constant, straight answer whether she could claim from the card company (se3ction 75?), 2 of the 6 people she has spoke to have mentioned as she didnt take out payment protection she's not entitled to any claim, I can only assume they are talking about ppi which i thought was a protection referring to not being able to pay them monthly payments.
    Any help would be gratefully received!

  • Does Sec.75 protection extend to non-supplied services which have been paid for by credit card. I paid for insurance cover over the telephone. A few minutes later the company called me back to say they had mistakenly quoted too low a premium. I confirmed that I did not wish to pay the additional premium being asked for and the policy was therefore never activated. I am still awaiting a refund one month later. Can I seek recovery from the Credit Card company?

    i was doing a training course when the company i was doing it with went into administration i paid a £250 deposit by credit card and the rest was buy now pay later (due next month) and if so how do i go about it

  • I recently bought two pairs of fake shoes from pradame.com. I informed them straight away that they were fake and demanded a refund.

    They told me to return the shoes as they may have sent the wrong ones.

    I told them that they had sent fake versions of the shoes i requested.

    They once again told me to return the shoes because they may have sent the wrong ones.

    Am i liable to pay the p&p to return them to china?

    Is there a quick fix if i bought them with my credit card but they cost less than £100 a pair?
