Section 75 refunds - article discussion

OK here's a complicated one.
Last year I bought tickets to an overseas Formula 1 race through an agent who, despite having a UK address on their website, turned out not to have one (as I found when I first complained). When I got to the event, I found the two tickets were in different rows so I wasn't sitting next to the person I'd gone with, and worse still the track marshals had a large awning over their position which badly blocked our view (I have photographic evidence of this). After many e-mails, the agent is refusing to give a refund.
So...
1) Is this likely to be eligible for a section 75 refund? Regardless of the view being blocked, I would expect any pair of tickets to a sporting event, theatre, cinema, etc. to be next to each other, unless otherwise stated. Clearly the ticket agency are responsible for non-consecutive tickets, as they had booked a block within the grandstand and could have issued me any tickets they chose.
2) I also spent a whole lot of money on flights and hotels, which were booked only because I was going to the race. Could I also claim back the cost of these through my card company?
Any help would be much appreciated!0 -

I would very much doubt it. You paid for, and received, two tickets to the F1. But check the Ts & Cs of the agent to see what was in the contract.0 -

Any legal basis for that? I guess I'm looking at it as faulty goods - if you bought a table you'd expect it to be free from defects, and as far as I'm concerned a pair of tickets costing over £800 that give no view are pretty defective.
I'm basing this on the UK Sale & Supply of Goods act, where it makes reference to "reasonable expectation", and that a reasonable expectation for a pair of tickets is that they're next to each other and offer a view of what they're supposed to.0 -
I'm getting married in December, and I want to put all my wedding spending on a credit card that is offering 0% on purchases for 9 months. If I pay for items over £100 on this credit card am I covered, even though I won't actually pay off the purchases for 9 months?
Thanks.March wins |Bouquet of flowers|

Hi - can anyone advise
I ordered a timberframe extension for my home from Benfield ATT.
I paid the deposit of £8,000 over two installments in December 2007 and March 2008 (final cost will be £23,000) on my Partnership Card (John Lewis/Mastercard)
I then went into dispute with Benfield ATT in September 2008 as they changed their pre site requirements (wanted us to remove the side wall and roof before they came on site - they had said nothing about this when we ordered the extension)
I went into their formal complaint procedure in September and have now reached mediation stage - although a date has not been set for this)
I informed Partnership card services in December that we were in dispute and asked for money back under Section 75. They asked for more details of the dispute/drawings etc but in the meantime we were decided to exhaust the complaint procedure before making a claim under section 75.
I therefore did not provide them with drawings and details etc as I decided to exhaust the complaint procedure.
I wrote to Partnership Cards in January and advised them of this.
I have received a letter this morning advising me that Benfield ATT have gone into liquidation (I assume this means bankruptcy) this letter appears to have been sent to all "creditors" by the liquidator.
I have been advised by my solicitor that we are unlikely to receive any of our £8,000 back from the liquidators and they may even pursue us for the outstanding £15,000 but it is highly unlikely.
As they are now in liquidation and will not be providing us with the extension can we just go ahead and make a claim under section 75?
I was worried that there may be a 1 year time limit or something from the initial payment
Any advice appreciated?

Make the claim, under Section 75 your card company are "jointly and severely liable".
Inform them that the company have gone into liquidation and that you are looking to them for refund of monies under Section 75.
I am surprised your solicitor and the administrators have not informed you of this!
See HERE.
"How To Get Your Refund
If the company has gone into liquidation, telephone your credit card company and say “I would like to make a section 75 claim under the Consumer Credit Act.” They will send you a form to complete. Do not let the credit card company tell you that they need to claim the money from the supplier first: this is not the case. You are entitled to assert your legal rights regardless of whether they decide to pursue the company or not."Don`t steal - the Government doesn`t like the competition0 -

The solicitor was dealing with the dispute - we hadn't actually gone into how we had paid the company - should we ask him to pursue the section 75 claim or is it quite straightforward for us to do ourselves?

Jo
Just start off by contacting your card company, ( as per the link and quote above), your solicitor will charge you and you won't get that money back.Don`t steal - the Government doesn`t like the competition0 -
I booked 7 weeks worth of one night stays at the Hilton Hotel from the 26th July onwards. I asked all the right questions, ie can i get confirmation, what is each weekend rate, what does it include - breakfast, room only etc. Then the last and final question asked was IS THERE GOING TO BE ANY MONEY TAKEN OUT OF MY ACCOUNT NOW?
The operator told me that no money will be taken out of my account and that my debit card details are kept to secure the room and will only be used when i come to check out, then a payment will be made.
A few days later i checked my online back to be stunned to see that the Hilton Hotel has taken out £575 upfront from 5 of my weekends.
They told me that this was in conjunction with the room only rates! This was not stated on the Telephone conversation nore expressed when i asked specifically if money would be taken out, ie depoist.
Now the Hilton Hotel refuse to give me the money back, and my bank the Alliance and Leicester says they dont know what to do about it, if anything.
I took a copy of the chargeback to show them what could be done, but they didnt understand it.
how can a hotel do this without tell there customer and how can a bank not know how to help or suggest a means of help.
will not be staying with the HILTON HOTEL EVER AGAIN!!!!0
