We have been having some issues with a leaky ensuite since November last year. Now we have bigger issues with a bathroom company regarding the ensuite they supplied & fitted back in February this year. which they didn't complete till 4th April. We discovered a leak on 11th May. And up till now it's still not fixed. The person who fitted it has now left the company, however we got in touch with him last week as a last resort and he's agreed to come and have a look at it. I got in touch with the company today ,and told him what we've decided to do and said if there's any work to be done, we intend charge it to them and he said NO we have to charge it to the supplier. After chasing them since May and being palmed off with excuses that it's the suppliers, or the manufacturer's fault. we decided to do something about it.
So I got in touch with the credit card company and they have opened a section 75 dispute, and we are to send them all the details with a cover letter. We only have 14 days to do this. Now I just came across a template letter on MSE and I was going to use that. But it says to include the amount to be reimbursed, I don't know what amout to put in because it's only a part of the shower that's leaking due to ill fitting seals. Can I still use that template although I'd already spoken to the card company? , plus i really don't know how to work out how much to claim for the inconvenience of not able to use the shower. Sorry for the long winded story but I'm at the end of my tether and very very stressed. We are both pesioners with mobility issues, hence the reason why the ensuite had to be refitted. Any advice will be gratefully received.Thank you.0 -
We had a new UPVC door made and fitted in September 2018, once the door was hung the fitter realised that there was a problem as it would not open to 90 degrees (so not open fully) and told us that a new one would need to be made and re-fitted. We paid a deposit on the credit card. I refused the offer from the company to shampher my internal recess to allow the door to open and insisted that they make a new one with the correct specifications which would give the door clearance from my recess. They had agreed then retracted this offer to remake the door when I asked for an update and told me to seek a door elsewhere. After contacting 3 separate UPVC companies, it was clear that no one else would quote on our door (Goth shaped arched door). We then had to get a quote for someone to make a wooden door (what we had in the first place) and get us back to a position we were in before this UPVC door was fitted. We approached our CC company to claim as breach of contract, and after supplying them with proof that we cannot get a UPVC door, they upheld the claim as in paid us our deposit back and agreed to cover the costs of remedial work.... The CC company obviously contacted this company as the company is now coming back to us insisting on full and final payment. We thought we would pay this to get them off our back via the CC again, but they are refusing payment by any card and want cash or bank transfer. We are at a point of losing the will as I do not think we will have any form of protection if we pay cash. So payment owing £1485, new wooden door £2800 and I can't see how I can claim any of this back.
I seriously need help, they have given us until next Wednesday to pay or will issue a county court claim against us. I do not have the nerves for this. I sought advice from a solicitor who claims my Insurance legal cover would not cover if we went to court as the claim is not proportionate to the costs involved to get it to court.
Any advice would be greatly appreciated as we are so close to the bone with this and feel as though we don't have any rights or anywhere to fall back on...0 -
I thought I’d covered every base booking my holiday, but sadly not.
After arriving at our ‘luxury’ we found that the accommodation wasn’t at all what we expected. Dirty bedding, cracked electrical sockets, leaking toilets, no smoke alarms...basically a health and safety nightmare into which I brought my two disabled sons and 85 year old mother. Cable tv and a jacuzzi were also promised, but the subscription hadn’t been set up and the jacuzzi didn’t work and also leaked waste water over the floor because the waste pipe was faulty!
I contacted trip advisor and was told by the customer services that I was covered by their payment protection. I’ve sent them a list of the faults with photos.
However because I didn’t contact them on the same day we arrived (although well within 24 hours of arrival) they’re now trying to wriggle out of any compensation claim. They’ve offered me €330 as a gesture of goodwill...but the villa cost €6100!
I thought because I had bought it using my Halifax clarity MasterCard, I would be covered by section 75. But because I bought it via PayPal (the account is connected to my credit card) I find I’m not.
PayPal have taken up the mantle now, but what’s their record like for getting money back?
Trip advisor have taken down the advert on their website (so they must think my claim has some validity) I’ve reported the villa to the local tourist board and trading standards.
I don’t expect a free holiday, but I would have liked what I expected from the advert. Any suggestion what I can do now to seek compensation for misrepresentation? Many thanks0 -
So quick question about Thomas Cook section 75 refunds (might not be right section of Forum) .... Whilst claiming back the costs of the flights (only) can i also claim the difference on the new flights that we are having to purchase in order to fulfill our holiday - flight prices have gone crazy since the announcement. Accommodation was booked with a separate provider so this is still in operation.0

I used my Hsbc Turkey issued MasterCard to purchase flight tickets from Thomas Cook. My bank are saying that the card is only a payment tool. What are my options ?0

I was wondering if you can advise. I have paid over £200 to invest in shares. The company is a fraud and I tried to get my invested money back. They are not responding so I tried my credit card company. they did not upheld my claim. They stated 'if a purchase relates to investment, it is not covered under the Mastercard dispute process. Is there any way I can get my money back? Thank you for your help.0 -
I recently employed a limited company to undertake an ensuite bathroom refurb. The quote provided was for labour only, all other materials were purchase via credit card for the job. As the job is potentially being taken to court for poor workmanship (I cannot now get hold of the builders as they are not responding to calls/emails despite a meeting and agreed resolution for repayment) I did think I may be able to recover some of the costs on a Section 75? Questions are; 1. Would this be valid? and 2. Would I be covered if some of the goods were paid via Sage Page on my credit card?

I'm about to make a Section 75 claim but not entirely sure it's covered so wondered if anyone knows?
In essence;- I paid a £300 deposit on Credit Card for a holiday for my wife.
- Several months later I settled the balance (BACS payment as the companies online payment system was down so I couldn't pay by CC), but accidentally paid for both my wife and the friend she was travelling with.
- The company acknowledged the overpayment and promised a refund (along with some compensation for a change in room).
- After a couple of weeks chasing, the company went into liquidation and ceased trading
I believe that they've breached their contract (to make the refund), but they did deliver the goods (the holiday).
Does anyone know if Section 75 covers the refund?

Warning: I purchased many items for a bathroom renovation from one shop. I paid for the total bill using 3 different credit cards, paying about £500 on each. I am having problems with a faulty tap costing £190 but it is not actually itemised on one specific credit card. If I needed to claim under Section 75, from which card would I claim? I recommend specifying items on separate bills for each card.0

I purchased a ‘leather’ bag online with my credit card total £35 (not the £100 Martin spoke of tonight on MLME Tonight).... but it’s not leather- the seller says it’s PU leather and not giving a refund. Have contacted credit card and they’ve sent forms however turns out the company is based in China and operates as a computer company? Have filled out forms CC company have sent just wondered is there any hope for me?0
