Bankrupcy while employed - half pay salary (sickness) and SOA

    Oh, no - I am not about to "tell porkies", not at all....

    Just had an email reply from my HR and it is (in a way) some good news.

    I got the dates slightly wrong, my half pay kicks in from 24th October - that means I should have money for the BR fees from my October salary as I have alrteady spoken to CCCS and they have cancelled my November DMP which would be 500. I wont get the full pay at the end of October (between 24 and the end - half pay so 3 weeks on full pay and 1 week on half pay) but in terms of being able to pay the BR fee - excellent news :)

    On the phone now trying to locate which local court deals with personal BR - been on hold for agessssssssssssssssssss. Want to find out what is their appointment system etc.

    OK, got through and there is no appointments as such.
    One has to simply turn up between 10 am and 12 on any weekday.

    Is it good or bad?

    Not really , no extra waiting - will go to court 30 or 31st October as I get paid on the 29 th.

    Just need to get all paperwork ready for then.

    My first half pay slip will be end of November, hopefully will have to wait for the OR interview a bit and it works out nicely.

    Or should I wait filling in for BR till I actually go onto half pay?

    When you fill in the forms and go to court you have to fill the SOA in as your income stands at the point of going to court. The OR interview is usually about 2 weeks later at that time you would tell him that your income is going to change as of such and such a date and he will send out another SOA to fill out.

    Or you could keep hold of your fees and wait till you get the pay slip with the half pay on it and do then. It's up to you and depends how much the creditors are hassling and whether you can put up with it.

    Creditors not hasling at all - nobody has my number and as I was paying the DMP (last payment 1st October) - I was happily ignoring the few letters they have sent me.

    Looks like I need to think this through.

    If my SOA at the point of going BR at the Court shows large "surplus" (full pay) but when I see OR after my first half pay pay slip - what hapens then? Would this count as no surplus (no IPA)?

    Part of me wants so much do to it ASAP as to have next year's Xmas to look forward to being discharged - but do not want to make a wrong move.

    Should I wait till half pay to start it all?

    If your income changes between the court and the OR then just tell them at the interview or ring before interview and they will send out the new forms. You also get to speak to the OR on the day briefly so you can give them the heads up then. It really is up to you, it's completly your descision. But for what it is worth if it was me I would wait until I knew what my new wage would be then walk into court with the completed forms the next day.

    Tigerfeet - thanks again.

    My proper half pay will be on 26th November but will take me a while to get hold of my payslip - I would not like to go to collect it myself and they won't post it to me straightaway.

    I think I will go for it at the end of October as I would so much like for this to be done and over with.

    Also, do not trust myself to be good at keeping the 500 for BR fees- with Xmas coming.. better get it done and over with and then deal with OR when interview comes.

    I am just glad that I will have the 500 for the fees... big relief.

    EDIT - Actually, I will know from my ebanking how much I got paid on the 26th Nov - does the court need payslip with SOA?

    Court only need the bc forms and any ID if your claiming fees back from (but your unlikley to be eligable with your income) so no they wont, the OR will want them, but if you dont have them at the time when you need to send stuff to the OR, you can send later on. Its a quite flexable process. Its not going to hold anything up, and the OR will see your income anyway from your bankstatements.

    TBH I think the sooner the better as the OR will see the drop in salary anyway, and worst case scenario is you have to fill in another SOA, where your income will drop but nothing else will change anyway.
