Urgent Advice Please - Residence Order

Please can someone help me. My ex has got residence order over our 2 year old daughter. To cut it briefly, my mum died 3 days after I gave birth to her and I just lost the plot. I was "bullied" into accepting that I was not a good mother and hence my gorgeous little girl lives with her dad. I have regular contact with her but yesterday he told me that he is taking her out of the country for 8 weeks!!! He has also got a son who lives in Turkey and he abducted him out of Turkey 8 years ago. I am so scared that he will not bring her back. He has moved house and I dont even know his address. PLEASE HELP! WHAT DO I DO TO STOP IT?

    Do you have parental responsibility ? If so you can object to him taking her.... seek advice from your solicitor

    I assume because I am the mother that I still have parental responsibility. I have looked all over the place on the web and it says that the only time a mother loses responsibility is when the child is adopted.

    In that case I think you might be able to get a court order forbidding the father from taking your child out of the country without your consent?

    I would agree with the above posters. I would drive myself into a right state, wondering and guessing. First thing in the morning, get an initial consultation with a solicitor. You can always see a couple, this is such a serious matter, you will need to 'feel' that your solicitor is 'on your side' and supportive of you.

    When you are clear about the facts, you will be able to deal with this far better. After all it is more than possible that this is indeed just a long holiday, so please try not to panic, far easier said than done, I know.

    Unless it has been official withdrawn from you, and believe me you would know that, you still have parental responsibility for your daughter.

    Thanks for all the advice - I am just going crazy in my head thinking that he wont bring her back! I know what he is like deep down - he is a bully and thinks he has the right to do what he likes.

    I have already got a solicitor who I think the world of - I have already email her but she is not in until the morning.

    He has stopped speaking to his mother (which was our only form of contact with him) which just makes me more suspicious.

    I'm going out of my head!

  • Hi, i don't think he can take her out of the country for longer than a month without your permission (the paperwork you should have been given from the court about the residence order should say?)

    It is possible to get something called a Prohibited Steps Order - your solicitor will advise.......this has to be applied for through the Family Court & which a judge would have the power to award to you.

    This is turning into my worst nightmare ever. I spoke to my solicitor this morning and no-one can get hold of him!!!! What if he has already gone with her? She is starting to panic now as no-one has apparently seen him since I last saw him on Saturday!!!! I knew I should have rang the police.

  • Why don't you ring them now? Personally I think posting on an internet forum is just wasting precious time...

    Thanks but the problem is that I dont know his address. I have called the police and they are looking into it! But they are more or less saying that I need to get a prohibited steps order. I will get on it first thing in the morning - my solicitor did mention it this morning and I said to her to do whatever - quickly!!
