I'm in dispute with my ex supplier e.on after they wrongly debited £1,200 from my account (which they later refunded). I still owe them £35 (the correct charge) but am refusing to pay pending my complaint, as the mistake cost me bank charges etc.

It's gone quiet at the e.on end and they've called off the debt collectors. But to my amazement I've got a seemingly unrelated letter today saying they normally gave me a discount on my bill but hadn't done so on my final bill, therefore they'd like to give me £25!

They want me to phone to arrange this. Anyone got any idea what's going on?

If Eon debited £1200 without authority, you should have contacted your bank to have got the refund under the terms of the DD guarantee. When you contacted the supplier, they should have referred you to your bank to obtain that refund, again under the terms of the DD scheme.

When you make your claim with the bank, the bank would have immediately refunded the £1200 and would also have made a compensation claim for consequential losses if asked to do so, but these are only met once the supplier refunds the bank the charges claimed.

As you haven't used that system, it looks like you'll end up in court if you don't pay them what you owe (however much that may be).

You'll need to claim (or counterclaim if appropriate) for any losses incurred due to the alleged errors they made. They may defend such claim on the basis you possibly didn't mitigate any losses by (a) contacting them after the advance notice was received but before the payment was collected (b) contacting your bank to dispute the amount that was going to be collected before it was or (c) not taking advantage of the safeguards extended to you under the terms of the DD guarantee even after the payment was taken.

I'd give them a ring to see what you can negotiate.

  • Just as I was leaving work at Eon yesterday evening one of my team asked about the £25 because they'd started taking calls about it. I haven't seen or heard anything about it but I can find out next week. It was previously a process that gave a correct discount based on what you were due, not a flat £25.

Thanks Premier. Once I noticed the withdrawal I contacted them but they insisted it was correct until I wrote to them and they then refunded pending an inquiry which eventually found in my favour, that the bill was based on an incorrect reading.

Cheers Bry, I look forward to finding out what it's all about.

I didn't think Eon applied discounts to a final bill

    4 Ending this contract
If you have recently asked to switch your energy supply to us, you have 14 days from the date you entered into this contract to stop the switch.
If you wish to cancel the contract after this date, the contract will end when your transfer to another energy supplier is complete. We will close your account to the final meter reading. No discounts will be applied to the final bill and you must pay the balance in full. If you have not paid an outstanding energy balance, we may stop you switching that energy supply to another supplier. This contract will end if Ofgem nominates another supplier to provide energy to the premises.

  • They don't now but there was an issue with accounts that ended prior to the current T&C's that removed the final discount.

I'd have just contacted my bank and told them under the DD guarantee scheme to grab back the payment and also refund any bank charges incurred.
