Oh she sounds like everyones nightmare of an ORs apprentice then. Sorry just seen you have added the child activities.

Car tax paid twice a year equals £16 per month I think as well, so another £6 per month under.

Your gas and electric seem hellishly low, and they WILL go up as we all know.

Also think they allow £49 per adult on clothes so again yours is low to include a child. I worked out the other day my sons school uniform just for this year, it cost me (and it is compulsary) £189 and that is without a coat or school bag, books or pens etc. Add the bag and coat and we are looking at £247 and that is without the socks and underwear needed, let alone his out of school clothes!

The £100 petrol, how far do you have to travel and were you asked that?

  • 31.7.28 Extra curricular classes/activities for children

Whilst it can be considered reasonable to allow expenditure to be claimed by the bankrupt to fund one extra-curricular activity per dependant child, any claim for additional extra-curricular classes/activities should be funded by the bankrupt from any surplus remaining with them after deduction of the assessed IPA/IPO contribution.

    31.7.29 After school clubs

An expenditure claim for after school clubs can be allowed if they are used to provide childcare whilst parents are working. If the use of the club (s) is simply a matter of convenience for the bankrupt and/or his/her spouse/civil partner/partner the bankrupt should be informed that the cost of funding the club (s) must be funded from the amount of surplus income left with him/her after deduction of the assessed IPA/IPO contribution.

Does the second apply re a form of childcare? just a thought if they try reduceing that

I had seen this BAAB and while re doing my own SOA reckoned on it being taken out as the after school activity, as it is not in school, but then I will also add the money I pay to a friend during holidays to have him and see if they try to take that out as well.

I know they don't allow pocket money but to deny kids anything is a joke, a fiver a week is what cinema, swimming, a game of badminton or to attend the local youth club, or of course we could have them all on the streets causing mayhem and madness for people!

I think this particular ORs person has really taken the pee, which is why for me the whole SOA has to be looked at to what they COULD take off if she complains.

I think the car tax is £6 under what it should be for starters and that is being honest not diddling anyone.

Yes but you dont need too if she disregards CB fully as she should:rolleyes:

If you complain and she threatens you in any way re car or anything else, lodge a formal complaint imediatly with her line maneger. shout if you need any help, but they cant be allowed to abuse there position like this, its not as if your on a good income, and i have seen many with a higher income keep the car and be a lot better of than you are going to be, this is why i really disagree with IPA,s The control on there calculation leaves too much room for abuse/error

But when they count CTC as your income how can they justify denying you kid/s anything such as this?

Its a case of wanting there cake and eat it IMO as they are using CTC to increase your income, but dissalowing items for your kids that CTC is payed to provide for them:confused:

To say it stinks is an understatement, and for them to try to use CB as well is just taking the Pi$$.

Sorry but i feel very strongly about this, and have done since they changed that section, they didnt always count CTC before, ok it was a grey area but they have gone the wrong way IMHO:rolleyes:

  • Just as a point i was told that by the caseworker person (whoever she is!) that there are moves to include CB as part of income (maybe i was the test case lol)
  • Its already been decided in court
The only exception to the inclusion of state benefits in an income payments calculation is where a bankrupt is in receipt of child benefit, which is not an income based benefit (unlike child tax credit, see above). The High Court has stated as a matter of public policy that child benefit should not be included in the statement of income when applying for an IPO and there is no reason why the same principle should not be extended to cover IPAs

I think if she said that a formal complaint needs making now she is abusing her position to meet targets

What she said WHAT, come on where is this person coming from, there are definates on CB ie cannot be included. Now if that is gonna change in the future, that is NOT NOW. so you cannot be taken as any guinea pig to see if you bite or not.

Makes me like BAAB as mad as hell.

Has she got any kids, does she know what they COST to run as sure as hell more than a car.

I am incensed already to read a child is anything from 0 to 16.. ha ha.. does a 5 year old eat what my 14 year old does, does the 5 year old have VAT added to clothes is he/she 5 foot 7 with the appetite of an APE.. no.. but they are treated the same on an SOA.. what a joke.

They already took away the Child tax element, Gordon Brown please tell ME why it is paid to keep kids not anything else, if they go the same route with CB what is the point of paying it out to parents.

Whoever your ORs assistant is she needs a shot up her royal backside!
