talk soccer something else just occured to me. As you were selling it second hand/used (you mention it works OK in your machine) maybe there is a scratch or something on it preventing it from playing. Also, can you remember what was marked on the DVD case, did it actually state which system it ran on or did you originally just buy it as a region 1?

The more I think about this the more I think you only have two options. Firstly, to ignore the silly threats about reporting you to the police etc and just accept your neg and put it down to experience. Secondly, just to swallow the refund. The only caution I would add is if there is the slightest doubt in your mind that this might be a hacked or pirate copy (ie region free bought from abroad) then that is illegal in the uK and the police just might listen to a complaint if they can be bothered.

One of my machines here is much more sensitive than the other and often will refuse to play anything that is marked or even dusty. Also, can you remember what was marked on the DVD case, did it actually state which system it ran on or did you originally just buy it as a region 1?

Give him his money back then....if the police worry you.

Is it all worth the stress.
  • don't forget though... once you've given him his money back then he's already got a 'copy' of it.

  • "sale of goods act 1979". I got that of him to along with small claims court under the "supply of goods and services act 1982" , through the Ebay fraud procedure or other means.

So i decided there will be no refund what so ever and he can do what he wants to please himself? The payment i got is now over 30 days i got in paypal and i also have the tracking number. Can anyone tell me once he goes through this fraud procedure what will happen and the steps to follow etc?

*btw he has just sent me pictures telling me the item is a bootleg when it aint. He has clearly taken other pictures of the item and goes he will pass it on to his case. This is becoming a total joke, will ebay believe me when i tell them that is not my item when its the same name too? >:(*

If I understand your last post correctly the paypal payment was made over 30 days ago? If that is the case then ebay will not be interested, nor will paypal. There is a strict 30 day limit for claiming against paypal, and then a claim can only be made for non delivery, not for faulty goods.

His only option now is to take it to small claims, or to report you to the authorities for selling bootlegs, and then of course you have to wonder if anyone will listen to a claim when he has had the item so long. Small claims might also cost him more than the item cost in the first place anyway.

I still think you have two options, if it is worrying you that much then refund, but make sure you let him know it is without prejudice. Or secondly, just ignore his mails and wait for him to make another move. Idle threats in an e mail won't hurt you, ignore it all and wait to see what he does next.

Either way, if and when he negs you reply calmly.
