Asda grrrrr

Please dont anyone bite my head off if this is in the wrong place, Ive looked and Im just not sure where to post this!

I had an email from Asda this afternoon telling me an order I placed, the payment had not gone through and they would be taking the payment today.

I initialy thought it was spam but looked into it and hubby phoned asda.
In december 2007 I made an order with asda entertainment and for what ever reason they didnt take their payment. I have checked my bank statements and they didnt take payment. I dont know how I missed it at the time as I check my bank quite carefully.
Anyway I have rung asda and the woman I spoke to said she is in the same boat, she too, along with a lot of other people placed orders in december and for some reason or another there was an error and asda didnt take payments. They have emailed everyone today, informing them of this error and have already processed payments today.

Can they do this? 9 months after the order, can they just take money from my account?
I have spoken to my bank and they said they dont know and to contact the CAB.

Trying to get intouch with my local CAB is like using a chocolate fire gaurd!

Can anyone advise on this? Can asda take money from my account that was meant to be taken 9 months ago?

If you have a cheque you have so long to cash it, surely its the same with card payments?
I just dont know! :confused:

    im guessing there was a glich in the system but ultimately you recieved the goods so you should pay for them. im not aware of any time limit, you didnt pay by cheque so that argument is of no consequence !

  • im not disputing the fact of whether or not i should pay for the goods i received! Nor am I trying to say I paid by cheque, what Im saying about the cheque is that you have a time limit to cash a cheque surely there is a time limit on when a company can use your card details to take money from your bank account.

    Im disputing the fact that asda have given me absolutaly no notice at taking a payment they should have taken 9 months ago, which they didnt take through no fault of my own.
  • Actually, they have up to six years to claim the payment from your card after you have authorised them to take payment.

    The OP isn't disputing that they owe the money, what they are unhappy about, is that they received an email TODAY, telling them that the outstanding payment (from 10 months ago almost) would be taken TODAY.

    I too wouldn't be happy, but I'm not really sure what you can do.

    Did you have the funds there to cover the payment?

    My guess is if they are catching up with these payments all at once, it won't be long before they hit people who haven't got the funds sitting there and they will be charged. VERY unfair IMO.

    Surely they should have given some notice!

    As well as the 6 year to claim on an authorisation code it's also in credit card terms and conditions that interest can be charged from the date of purchase!! (I hope you paid by debit card ;))

    That's why I replied "Just pay up", never implying the OP was trying to get out of it.

    I will very readily concede that it's quite unusual for a company not to come back to customers for outstanding debts until nine months have passed. I fully agree that ASDA should give people sufficient notice, so they have time to ensure the funds are there.

    Legally, however, the case is unambiguous.
  • yes i paid by debit card, and no, again, i am not disputing that i owe them the money that is not the issue at all. the issue is that they have given me no notice what so ever.
    No, the funds are not in my bank for the payment, so the bank has said I will be charged. Asda have now said if I can prove the charges were caused by them, which I can, then they will pay for the bank charges.
    Which is fine, Im not out of pocket and they will get they money when they send for it again.
    But still, its the principle of the matter. They gave me, and everyone else no notice at all.

    if you had been more careful you would have seen the payment had not gone from your acc, either you are not very careful or you realised the payment had not been taken and were hoping they wouldnt realise now you are peed off because they have realised their mistake , its not something they did to wind you up so get over it life is way too short !
