If I was your son, I'd try and nego with the LL ( without admitting any liability - "without prejudice negotiations"), before this all gets out of hand.
Something along the lines of "it wasn't me, I didn't say it and I won't say it again".
Your son is remarkably relaxed about this, letting Dad do all the running around on the 'net asking advise, I recall your last "that's my boy" speech, and realise how precious he must be, but does he have a broken leg now that he can't do some finding out himself - after all, he got himself into this mess.0 -
rubbish, the landlord is sueing for a slander that he cannot prove and for losses that he cannot substantiate. The courts should take a very dim view of this IMO. I'd be inclined to countersue for frivoulous wasting of your son's time.
Well thankfully your opinion won't count for much, it will be up to the Judge on the day.
Well, if he didn't do it, then all he has to do is make a signed statement to that efect, and put the case to bed, no need for anyone to worry or lose sleep.
If the agent who heard all of this makes a sworn statement (and he may have to) then the question of proof becomes very much easier.
Will see what happens when it gets to court, may be the judge will just award £1 in damages, but that may be enough.0 -

On the point of vowing to approach every tenant, it's his word against that of the Agent who is unlikely to even turn up at court.
Secondly, you cannot be sued for telling the truth.0 -
The agent, and the tenants who didn't take the other property.

So far, the LL hasn't had his chance to speak here, just the boy's father, so it is hardly unbiased. Something upset the landlord enough to serve summons.0 -
Even if the agent gives a sworn statement what can he actually swear to? He can swear as to what the son said, and obviously we don't know exactly how it was worded as we were not there. But the agent can't swear that this stopped the couple renting unless they had said yes we will have it and later changed their mind. Even then how can the landlord prove a loss unless he couple can be called to swear to them pulling out because of this discussion. So the landlord has to prove all the following 1) What was said
2) That this was slander i.e untrue
3) The couple would definately have rented except for this discussion
4) The amount he has lost through the alledged slander
As long as the son takes all his eveidence before the judge and is calm an dreasonable in court the judge is likely to laugh this all the way out the door, and that assumes it will even get as far as that the AQ's haven't been done yet and the landlord would have to actually turn up in court. Even the banks fail to that on a regular basis.
Get son to put in defence and await the possible AQ. Gather together your evidence and wait it out.

It's true that we've only heard one side of the story, but based on the information we've been given, it seems as though the landlord is a bell-end who is trying to bully Z's son, and it doesn't appear that his claim has legs.
There's a lot of gratuitous landlord-bashing on this talkboard which I find pretty pathetic, but this doesn't appear to be the case here.0 -

Actually what pee's me off is that some chopsy kid opened his mouth, but hasn't got the eggs to post on here and ask himself, leaves it to his Daddy to do. Let the boy grow up (teach him to keep his trap shut -no smoke without fire etc), guide him by all means, but let him grow up a bit. Good lesson for the future too.
I wonder if his dad puts his jim-jams on for him too , and leaves a skin on the dressing table?0 -

Captain Mainwaring, please read this very slowly as it is obviously not sinking in. We have already established that you couldn't care less about your children, but I do. My son doesn't know that I have posted here, so having the eggs doesn't come into it.
Most normal people will do whatever it takes to help their chidren and that's what I am doing, he has been in this house for 5 months and in that time the hot water system has been faulty he has tried very hard to get the landlord to repair but has failed. All he done was tell the truth to help prevent another couple having the same grief.
So I will ask you not to corrupt this thread and go back to pulling the legs off spiders or whatever else gives you pleasure.0
