GAME store problem - advice?

Hi everyone
I'm looking fo advice on where i stand with a games console purchased through Game online...
Here is the email i sent them....
On the 6th June i purchased a pre owned xbox 360 from yourselves online, unfortunately, after a short while it
displayed a hardware fault. I was advised by Game online that i could return it to you or go into store to exchange it.
I subsequently exchanged in store. Since then, i have had to return the exchanged xbox 360 3 times to my local store,
each time dislaying different faults (which were of course confirmed at the time by your in store collegues.
The latest pre owned machine has now failed. As you can imagine i am rather fed up by the problems i have had with
pre owned systems.
At the weekend i purchased a new XBOX 360 from in store for my other son and i would like to be able to return the
pre owned system and exchange it for a new system in store (paying the difference of course).
Will you allow me to do this?
Looking forward to your response.
Basically, the pre owned system costs £20.00 less so i would pay this difference. As far as i see, the pre owned consoles are not fit for purpose.
I paid for it on a credit card.
This is the email i have just received....
Thank you for your email.
I am sorry to hear of your disappointment with game.
In regards to the problems you have been having with your XBox, I can only apologise sincerely.
Unfortunately, we are unable to exchange your faulty preowned console for a new console as this is against our returns policy. Also this comes at an extra cost we are unable to honour.
Sorry for the inconvenience you have been caused.
Any thoughts on how to proceed appreciated.
thanks

Can you not just ask for store credit for the value of the returned pre-owned Xbox, and put it towards a new one?0

Thanks for the reply Noz.
I thought i would try the exchange route initially - which they are refusing.
Can they legally refuse my request for a refund?
thanks0 -
If the Xbox is faulty within a short space of time of purchasing the item, as far as I'm aware, then they should refund you if that is your preference.kogsawelly wrote: »Thanks for the reply Noz.

Personally, receiving store credit and putting it towards the purchase of the new xbox would seem to be easier all round.0 -
Why did you buy a pre-owned one when a brand new one is only £20 more?
As it's been faulty and returned SO many times, I'd say you are quite entitled to a credit note at the very least, if not a refund. Go into the store and kick up a fuss! If they refuse, get the manager on the phone to agree to it! The replacement option has failed several times, so they need to do something else now!Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
The pre owned consoles would be fit for purpose if the store tested the consoles,0

Hi DCFC79
I have been carefull to follow the instruction on placement and setting up the console. It has had moderate use - approx 10 hours use a week.
I am not sure that they are fit for purpose, if they keep going wrong!!!
I will argue that it is a breach of contract because they are unable to supply me with a unit that lasts more than 5 minutes! That isn't exactly durable.

Can we clarify
You bought Xbox 1 returened it for Xbox2
Xbox2 was repaired or replaced with xbox3
xbox3 replaced with xbox4
etc etc Has it always been replaced not repaired, which number xbox are we on now? Your OP sounds like we are on Xbox5 ?0 -
Why dont you just buy a new 1,0

Why dont you just buy a new 1,
It would make sense to write another letter quoting sale of goods act, and rejecting the item as not satisfactory and requesting -yet again- an amicable solution of a refund against a promise to purchase a brand new model.
If this fails (again) then, yes, OP could buy another one, and persue the refund/compensation threough more letters and court action. But OP might be of the opinion that they want to get this issue sorted BEFORE buying a new one. And tbh I would want it sorted before I bought another new one.0 -
It looks to me like Game have not read your email properly, it looks like they think you want to swap the broken used one for a new one.
Go to a store, and speak to someone, or phone the head office.0
