    Lack of MOT doesn’t mean death-trap which is why lack of MOT doesn’t attract points and only has a small fine attached.

    Death-trapism (sp?) is covered by other laws which do attract points and bigger fines

    I never knew that. I think that is fine if your car is ok - but what if you were driving a vehicle that was in a really bad state that could cause an accident and harm your passengers or others?

    That would be very irresponsible.. but then again, how would you police it? What would be they right way to deal with people who had no MOT? Would you fine/give points, according to state of car??

    Above is theoretical and speculative.

    There would be a charge of failing to comply with construction and use regulations, which can be minor C&U and more serious C&U violations - dealt with by 2 levels of max fine. In practice, however, the police will only do a visual check of the vehicle -basically looking at tyre tread and for any obvious bodywork problems. They very rarely have the vehicle proffessionally examined.

    Its easy to overlook MoT's. Ive done it myself. I have no idea what the penalty might be though perhaps we should all buy one of those dodgy motors that are sold at impromptu used car lots which seem to spring up on every bit of waste ground. They usally cost a couple of hundred quid and no doubt many of the buyer belong to the underclass,crooks or immigrants who can then pretend they dont speak english. What about all these dodgy foreign plated vehicles that are flying around? Ive even seen UAE plates on UK roads. Who drives from the UAE to England? Sounds like an iffy import to me. Anyway word is the the police dont bother with these are the ANPR cams cant read them and they are virtually untraceable/not worth the bother....

    move along now,theres nothing to see..

    The powers police use to "impound" cars is section 165 of the road traffic act and covers driving without valid insurance or driving otherwise in accordance to your driving licence (driving without a licence) It does not cover driving without a valid mot cert.

    It is easy to overlook the MOT and genuine mistakes do happen. For example, I was in hospital for a month this year and the MOT on my wife's car, which I always sort out, expired while I was in there. During the stay in hospital and my subsequent recovery I completely missed the renewal - even though it was in my calendar. As a consequence it was only three months later that I suddenly had a panic thought that the car didn't have an MOT. The car had been serviced the week before I got sick and sailed through the MOT with no faults, so there was no question of it ever being unsafe.
  • When I was stopped and had no MOT, I was summonsed for 2 offences, driving a vehicle without a current test certificate and failing to produce a valid test certificate. It went to court and I was fined £30 total, no costs. It was some time ago, MOTs were £29 at the time.

    I am amazed that there are 19 posts on this matter and the old no MOT= no insurance myth hasn't been mentioned once, things are looking up !!
  • Steady on.....

    Nobody is perfect, we are all leading hectic and manic busy lives ( well I am ), we get a reminder in the post for tax, which is great (except for the price we have to pay). We do not get a reminder for the MOT.

    Depends if you use a "professional", well organised garage for your MOT. I always get a reminder by post four weeks before the MOT is due.
    I used to have a signature but it disappeared and I just couldn't be bothered writing another, so please feel free to ignore this.

    I think it would be a great idea if MOT centres had to publish their pass rate. That way all the carp centres that failed everybody so they could get some work out of it, would either go out of business or have to start assessing vehicles fairly.
