Being told to pay

Hello

I own a Newsagents, I have a paperboy who had an accident whilst he was working for me doing his paper round.

Basically he was crossing the road and went into a Land Rover that was in motion. The wing mirror hit him and broke off, luckily he was okay and got up and carried on the paper round!

The owner of the Land Rover came in to see me and said I'll be hearing from his Insurance company, I spoke to my paper boy and he said he jumped the lights. He also said he didn't break the mirror.

I went through my Insurance company and they said I'm not covered:mad: . So, this morning I receive a letter saying I need to forward a payment of nearly £400:eek: or provide a valid reason for not paying.

Can anyone help....please

    Should you not have public liability insurance for your employees?

    In any case you can dispute this as the boy says it was not his fault.
    Who was the letter demanding money from?

    I thought I had that cover as I sent them my previous cover and they said they will match it and beat it.

    The Land Rovers Insurance is asking for the money.

    The £400 is for damage for the bumper, wing and mirror!! He's bloody milking it:mad:

    Tell them you do not believe it was your employees fault.

    See how they react.

    Does this mean you dont have proper insurance for your business? If so you better get that sorted pronto.
  • You should write back and say that the boy had some brusing which he noticed when he got home from him hitting the car in to him. His parents are looking for compensation and would like his address to contact him further so that their no win no feee accident lawyers can speak to him. That'll scare him off.

    I'd personally deny any knowledge of such an accident. Give the paperboy £40 and tell him he's getting the month off. That way if the guy visits, he wont be able to produce the boy.

    You could always argue the paper boy says he never did it. Without a witness to anything it's his word against the boys. Neither being able to prove it, then nothing can be decided.

    Having just read the exclusions it states:

    Bodily injury to any employee arising out of the use of any motor vehicle by or on your behalf.

    The previous policy may have just had Employers liability insurance which is legally required & would cover the paper boy for any injury he suffered. As Quentin says Public liability isn't legally required.

    This isn't relevant though, your paperboy wasn't using a vehicle on your behalf.
  • So the best thing to write back is to say ' I don't believe it was more employees fault' ?
