If you paid by Visa card you can contact your bank and ask them to chargeback that is they will take the money from the companies bank account via there own bank and give it back
As you paid by Paypal perhaps contact them0 -
ok thanks ill try paypal0

paypal have opened a dispute until 14/10 should i wait until then before trying to claim my money back. not sure if i should then claim from paypal or my credit card0

If you funded the paypal transaction with your credit card, then phone your credit card and ask for a charge back against the payment for XYZ amount on such and such date.
But there used to be a problem with some credit card companis refusing to do this with paypal and paypal causing problems with customers who have credit card companies who do it.
Perhaps someone (who knows) can confirm if it is still the same mess it used to be or can it definatel be done now in 100% of cases or definately won't be done now in 100% of cases...0 -
Im having exactly the same problem. Ordered my items on the 19th Aug and eventually received them on the 5th Sept, just minus the trainers.
Emailed their CS only to be told they had a computer error and the trainers were out of stock. There was no mention of a refund until i replied advising them il be looking for a refund on the trainers. A week later and still nothing was done so i again emailed and i received a response stating their accounts department should have done this and they would chase. Again, nothing happened so i raised the issue with Paypal and then escalated it through them to recieve this reply today directly from Paypal :
Dear ,
You have chosen to escalate your dispute to a PayPal claim. By ending communication with the seller, you are asking PayPal to investigate the case and decide the outcome. As part of our investigation, PayPal reviewed any communication you may have had in the Resolution Centre.
Our investigation into the following transaction is complete. As stated in our User Agreement, the claims process only applies to the delivery of goods. It does not apply to complaints about the attributes or quality of goods received. Therefore, we are unable to reverse this transaction or issue a refund.
Wasnt sure what else to do as it seems the money i spent on this has now been lost. Raised a complaint through the BBC Watchdog because it seems that they have some kind of scam going.
With regards to the charge back option, im led to believe this is simply on things like direct debits where the money was taking after the DD was cancelled. Apparently it doesnt cover the situation with chasing part refunds.
