But they've had 2 years in total... so therefore the refund would be £250 minus 2 years worth of furniture use, so about £50.
TBH, I wouldn't expect cheapo argos stuff to last much longer than a year or two, as some of it is shocking! It's usual obvious when it's first assembled that it's not going to last.
We currently have cheapo Ikea stuff, and previously had cheapo Argos stuff, and the Ikea stuff is much better, and at least you can see it in the shop to find out how robust it is!Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
The sale of goods act s.14 not as described (shown supporting a TV), not of satisfactory quality.in regards to
(a) fitness for all the purposes for which goods of the kind in question are commonly supplied
(b) appearance and finish,
(c) freedom from minor defects,
(d) safety, and
(e) durability.
You need to ask for refund, they will probably refuse and it's up to you to push them. Even though you have not had much use, I would expect a deduction of £50 for useage to be reasonable, giving you a £200 refund.
The small claims court is there to help you enforce this refund, but if you don't bother to use it then you will just be another one of the millions of people in the UK who never stand up to UK companies and you'll get nothing as a result. But Argos is one of our better companies, hence, they have already replaced the units, which many companies would nothave done.0 -
Wig, I'm as much for consumer rights and using the law as almost anyone on here, but I think you're setting her expectations too high. We're talking about a large piece of furniture for £100 (let's assume a £100/£100/£50) - you have to take into account the length of time you'd expect it to last, and I don't think partial refunds would necessarily be linear (e.g. 20% per year if life expectancy is 5 years). No offence to the OP but it's a cheap bit of tat probably made from reconstituted sawdust lined with plastic - I know because I've bought similar from them in the past. Expecting an 80% refund after 2 years (even if they've been replaced once) I still don't think is realistic. The sale of goods act s.14 not as described (shown supporting a TV), not of satisfactory quality.in regards to

I'd also take into account that this will be flat pack and put together by the customer, possibly badly! Not saying they have been, but that's what Argos could claim.
I would agree there's no harm in trying your luck though.0 -
Yup.
I was wondering when the soga rubbish was going to be come out.....such drivel....the magistrate will probably slap the the complainent for such stupid hearing.
Cheap tat now broken want refund 2 year use, your worship sir,
He or she is likely to laugh really loudly!
Also, people on here shouldnt raise another expectations just to improve their post count. Its wrong.0 -
agree with dangerous here, hope the small claims court finds in their favour and you lose your court costs. Too many people trying it on nowadays0
