Ok, but isn't this part of the problem though, do you not have to tax or declare SORN?

oh and about the certificates i should be able to get them for all 3 but the dvla say thats no good because they arent in my name. i had another fine since and that was one i drove to the scrap yard personally so i can get what they want for that. but my point is sometimes they send a reminder but they always send a fine grr lol

If the certificates aren't in your name how do you know they exist? Presumably if they're in someone else's name then they'd have been sent to that someone else.

Also if they aren't in your name does that mean the cars weren't registered to you? I realise you were basically rallying them to death and then scrapping them but without registering them you may be adding to your own problems.

  • all 3 cars were in my name, i have rung the scrap yard my friend took the cars to and they are going to dig out the certificate for the one ive been fined on and make a copy for me but the third car i dont know the reg for. they dont send out a certificate they have it and from what i gather it is an official document proving the vehicle was destroyed and reported to the dvla as destroyed. the certificate wont be in my name because i didnt present the cars to the scrap yard.

No, not if they have been officially destroyed and notified as such.

yes you do but surely not for cars that have been officially scrapped months ago and no longer exist.

Does not matter, someone will be named on the presentation certificate, first step is get the certificate. You can easily argue that your friends name is on the certificate because you instructed him/her to take the vehicle to the dismantlers, i.e. they are your agent.

The fact of this case is that you can prove the cars were destroyed
You can prove that the DVLA were notified
Therefore you can prove that the DVLA did not update the vehicle record -as they should have done- to change the vehicle status to destroyed - i.e. remove it from the register.
It is entirely plausible when you have the certificates and phone the DVLA and quote the cert No. the different person you speak to on the phone will cancel the fine, you just spoke to an idiot who doesn't know what they are talking about.

This is their error not yours, refuse to pay.

As per the 3rd vehicles registration, can you not phone your seller and ask them what the reg & manufacturer was?

Then use this website to check if it still exists. If it does not exist they will not fine you for SORN/notax etc. Also check the one they are fining you for and tell us what is says... "vehicle enquiry"
