DVLA... in my opinion inefficient money extorting so and so's

I recently recieived a fine for a car that i had taken away and scrapped, the company that took it are friends of mine, they took 3 cars at the same time and i only recieved notification of scrapping one so i wrote them a letter and they never replied then the next thing i know i have a fine for one of the cars no reminder just a fine. after speaking to the dvla they say they will only drop the fine if i provide a certificate of destruction on the relevant car in my name!!!. i found out from my friend where the cars went and it was an authorised treatment plant so the dvla should have been informed like i was promised. they say they can dig out the certificate of destruction but it wont be in my name so there isnt much i can do. the third car i scrapped i dont know the registration for and with the dvla not bothering to send reminders i wont know anything about it now until it gets a fine. any way whilst this was pending i received another fine through for a car i scrapped personally at another authorised treatment plant so i can get the cert of destruction but it annoys me that they didnt bother to send me a reminder on that car either.
i cant believe the dvla are allowed to be this incompetant and there is no governing body for them to answer to. does anyone know if i am entitled to find out what details they hold about me under the data protection act?

    Doesn't matter that the certificate is not in your name. The fact remains that you used a service provider for the destruction, and the DVLA was notified of the destruction, as borne out by the certificate.

    Either send them a copy of the certificate or get the certificate number and relay that to the DVLA.

    I'm sure you could ask for any details they hold about you under any act at all. It's information about you and I'd imagine you'd be entitled to know about it without quoting FOI (although it may make them respond faster).

    You said your friend removed the cars from your possession.
    At that point they, by law, are required to notify DVLA that they are now the owners. If they then choose to destroy them then it's their responsibility to notify them. If your friend doesn't tell DVLA that they now own the vehicle then the DVLA's records will show that you do. So any fines or correspondence relating to those vehicles will come to you - not them.

    If they do not transfer ownership to themselves then the DVLA will contact you regarding the car- unless you have told them it has been scrapped.

    Your story is a bit difficult to follow but I get the impression from reading it that the DVLA has done little wrong here - unless you post again and clear up exactly what happened. For example - you received notification of scrapping one - was that from your friends? the DVLA? the authorised centre? and you then wrote to them but never received a reply. Who did you write to? DVLA, your friend or the centre??

    I'm not being awkward - it is genuinely hard to follow.

    I read it that the fine was for another of the cars - not the one with the certificate.

    i received a ccj from dvla after selling a car sending them the relevent paperwork just before moving house i have been on the phone to them all day trying to get them to remove it and recommended that i send them a letter which i did about 5 today i am so p!ssed off with them
    you cant change yesterday
    but you can make tomorrow better

    You should apply to the court that the judgement is set aside on the grounds that you had moved and received no court summons.

    I'm not sure if they do a guaranteed retrial or if it is for the DVLA to take you to court once again in a new trial.

    In the new trial you argue that you did inform the DVLA, and they show no evidence that you did not, yet you can show plenty of evidence that they do lose letters. And in any event you have not been found guilty in criminal court of any offence, and you believe the DVLA acted ultra vires in that they do not have an independant appeal service authorised in law as is your right under article 6 of the human rights act.
  • the friend that scrapped them took them straight to the scrap yard on his lorry the scrap yard is an authorised vehicle disposal place and they inform the dvla which they must have done because the dvla wrote to me to say thanks for letting them know about one of the cars but there was another 2 and the dvla didnt write to me about them so i wrote to the dvla and got no reply then a fine but no reminder.

    as for the ccj thing thats what bothers me because i had exactly the same thing happen scraped a car then moved then found a ccj on my file.
  • oh and about the certificates i should be able to get them for all 3 but the dvla say thats no good because they arent in my name. i had another fine since and that was one i drove to the scrap yard personally so i can get what they want for that. but my point is sometimes they send a reminder but they always send a fine grr lol

    First thing to do, obtain certificates for all the cars.

    Even though you had the cars collected it should still name you on the certificate as the presenter. But even if it does not, it makes no difference, the DVLA were notified. You will win in court.

    What are the fines for?
  • not taxing or declaring sorn, i take cars off friends and family and anyone i can get them from cheap and drive them round the local track on a wednesday night and then if i can get them to the scrap yard i scrap them and recover probably about 60% of my costs meaning cheap entertainment but in this instant i let a friend take them as i had to get rid of them for a landlord inspection so not only did i take the full cost of buying them getting them there and fueling them and making nothing back i also have all this hassle and expense from the dvla to boot.
