Unfairly negged - chances of removal?

I bought a treadmill on BIN for almost £400, paid immediately and got an email saying it would be 3 days hopefully, but possibly nearer a week for delivery.

10 days later, they eventually answer my emails to say that, oooops what would you know, it is out of stock and not coming. So they've refunded me.

Fair enough, BUT - they've had my £400 for 10 days, and they didn't bother even telling me till I'd chased them up!

So I left them a negative (non-abusive, totally factual, and deserved!) And guess what?

Well of course they didn't leave me positive feedback when I paid - immediately and correctly. Oh no. They wait, and because they have a neg, they neg me - saying I should "learn that they are not responsible for their carriers"

Excuse me? I think you ARE responsible for keeping my money for so long and not even telling me you didn't have what I paid for! :mad:

So I've gone through the channel of emailing ebay to see if the unfair neg can be removed. I had 231 positives - a 100% record. I know it doesn't matter that much, but it really bugs me he can be so childish and retaliatory. And he's a Power Seller! :mad:

Why are they still being allowed to retaliate like that? It's getting so no one wants to leave feedback first anymore, just in case!

Does anyone know what the chances are of getting it removed? He wants to go for mutual withdrawal, but that seems to me he wants his gone, so he negged me then emailed asking for a MW. I really think I'd rather keep mine and leave his standing to warn others than have mine and his removed - that's how strongly I feel. But if I can have mine gone, then great!

  • Chances of having it removed are slim to none unless you come to an agreement with your seller, an agreement that will probably involve you agreeing to remove your negative feedback too.

    Sadly, Ebay are useless when it comes to asking for help in these matters and always make out that they are "powerless" to remove the feedback (funny that they can easily suspend your account without notice though...)

    You need to decide what's more important to you...having a clean feedback history or leaving a negative for this other person/company.

    He has now started an unpaid item dispute on me - hello?!?!? Can he even do that when it's all there on my paypal account for ebay to see?

    I mean - what does he think he'll achieve? He has said I didn't pay and haven't responded!

    I think I've entered an alternate universe. :wall:

    Yes he can start an NPB against you as your paypal payment has been refunded, it is an unfortunate loophole for genuine buyers.

    You know, I have a couple of items to sell then I think I'll quit ebay. It's gone beyond reason now, as a buyer or a seller.

    Everything I do on it goes belly up, or nasty, or it leaves a horrible taste in my mouth these days. I guess I shouldn't worry about the neg, or a strike then.

    respond to your neg so people can see you've had an idiot!
    take the neg on the chin and wear with pride, not having 100% stops idiots holding you hostage, i've had 3 negs now, only one of those was deserved as i forgot to post a parcel, the other two were idiots!
    money saving my @rse.
    I've spent 10x as much as I would if I had never discovered this website :-)

    Yes you can get a strike from the very simplistic view that although you did pay once, you have technically not paid at the moment.

    You could try a counter claim against the seller for non performance? It might get him to rethink the NPB process or go for a mutual.

    I tried that, ebay referred me to Paypal when I said I had actually already paid, and via paypal, and of course he has already refunded me, so what can I do through paypal?

    What I have done is initiated an appeal (maybe it's a bit premature but at no point did it stop me) I managed to email them the item number, full headers from the paypal receipt, and info saying he is trying to get a strike for me not paying when clearly I had.

    Who knows, it may work. I'm trying not to care too much because right now I cannot cope with this at all.

    If you have been refunded and the dispute is still open, if you paid again through paypal the dispute would automatically be cancelled. I don't think you want to go sending your £400 off again to avoid an NPB strike, though.

    Sellers are not allowed to refuse to accept payment at the end of a sale, though. I would certainly file a NPS complaint against this seller whatever else happens. (report link is tucked away under additional information)

    I have had this happen to me and it alkl gotsorted out -despite the seller being unwiling and a total idiot. Just follow the advice on here and it will be ok. It never seems that way initally, and you get all upset but the seller is just bullying and you get the strike withdrawn or as someone said as you paid by paypal you prob wont even get one.
    Try not to get upset- go do something nice and take your mind off it, the seller just wants to upset you so dont let them !
