This may sound silly but surely in a court of law if you have not signed a document with "your home may be at risk if you do not keep up payments" then technically they are breaking the terms and conditions as no where in the terms and conditions I have does it say they will go after your home? This is why the phrase is bandied about on tv adverts as well as CAs - how can they do this? Especially if you are willing to pay something.

Its a due to the fact the agreemant has been terminated by your default on it, so the creditor uses that as an argument, that in there view the agreement no longer is in force.

Still doesnt change the fact most people where not aware that it could happen as its never spelt out in the T&C, as you state, what they will do in the case of a default, but CO where rarely obtained due to the procedure before one could be issued, but if this law comes in that will change drasticaly, and will become aoutomatic IMO once a CCJ is obtained
Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(

There must be some very naiive members who think it couldn't possibly happen to them.

It can, and will, happen to every homeowner faced with a CCJ.
These banks will no longer accept DMP's if they know they will automatically be granted a CO when they apply for a CCJ.

Even if you're not a homeowner, please sign for your fellow DFW's.

well i keep telling others on here about it, but its still only 321

surely like peachyprice has said, are really a land of sheep just following others that think its all going to be okay?

ive been informed that the opposition party did oppose a lot of the information at the time - not saying all is bad but the worst bits are really bad. and i believe some opposition mps are glad there is a petition about it so they can relook at this so thats good news,

we need protection far more now then ever before, the banks are being bailed out by us taxpayers, and who will bail us out>>>

keep the faith as Bon Jovi says and we can improve things for us

there seems to be some movement on making repo with mortgage arrears more difficult, lets hope that this brings the whole question of securing ordinary loans into the spotlight as well.

Now is the time to write to your MPs on this, especially Opposition MPs as Labour wont want to step on their, ahem, 'leaders' toes
    :D:D stay wonky :D:D

....one-way ticket to Portugal booked !
  • I don't know how I have missed this but I have, this is shocking we pay the extra apr on loans that are not secured because we want to know that they are exactly that not secured. Off to add my sig now and bumping for anyone else who missed it
  • ...yes, thank you.

Thanks for bringing this to my attention and, in turn, thanks for bringing this to the attention of tens of thousands of other people via my company's intranet.

This is an IMPORTANT issue to address and one we shouldn't allow the banks to get away with.

Fight it. Fight it all the bloody way.
