Did It Today!!!

Well, as of 940 this morning I am officially BR. For those awaiting court dates, there really is nothing to worry about.

Got there at 9 for a 915 appointment. Met by a clerk who was very polite and professional. She took literally 5-10 mins to check the papers before I swore my affidavit.

I mentioned to her about witholding my address from publication. This is because I was a police officer and worked on one fairly high profile job and after that worked as a private investigator and may have upset one or two people. I was given a short form to complete detailing the reasons I wanted my address witheld.

Then it was off to see the judge. I was told he wouldn't have seen me usually, but he would want to ask about the whole address thing. So in I went to the Judges Chambers. Asked why I wanted my address witheld and he instantly signed an order saying it could not be published. Then asked me if I was sure I wanted to go BR and if I had received professional advice. I said yes and that was that.

Back downstairs and waited a short time for the order to be typed. Out of court by 0945. Couldn't believe how quick and painless it was!!!!

I was told the OR would ring tomorrow for a brief chat and make an appointment for an interview for a couple of weeks time.

Dreading OR thing. Think I will get a BRO due to 1k being stuck on CC just before I went BR - did it to pay the fee and also to live off!! Also think my LTD company will complicate things but hey, I now am debt free:j

Still got lots to sort out before my family and I can truly move forward, but this is the first big step.

Thanks to everyone on here who has given advice over the last couple of weeks. Even when I haven't posted myself, it has been so useful to read existing threads.

If anyone is nervous re the whole court experience, DON'T BE. It really isn't bad at all!!

  • Well done.

Sounds like we're going through it together as I was made BR last Friday and have my OR phone interview this Friday.

I didn't realise that the potential to 'upset a few people' should entitle somebody to preferential treatment. Why?

Sorry to sound Trollish but I feel this is a reasonable question bearing in mind that a lot of your creditors have good reason to be upset.
  • I would've thought it was for the safety and wellbeing of the OP and his family against anybody seeking their own form of justice. The address being made public puts innocent people at risk. Owing creditors money when they'll probably receive a letter anyway advising them of the OPs BR doesn't weigh up with having your home targeted by criminals and a family member potentially being injured or abused.

I would have to agree with you on this, and to be honest I admire the police, they do a thankless task at times, and in an instance such as this could be the target for people to take revenge if a name and address were to appear in a local paper.

I really do not think it is anyones place to judge this man to be honest with you, and his family could be at risk would you wish that on anyone as I sure would not, and as I have said I have nothing but admiration for the police service, I would not like there jobs, okay he is no longer in the service but he was and people have long memories! especially shady criminals.

Reading the OPs' post, and previous posts I get the impression he helped put some people in prison. Do you think it's reasonable for his family to live in fear if these people just because of financial difficulties?

Anyone who fears for their own or their family's safety is entitled to ask to have their details withheld from publication, it has nothing to do with upset creditors.

  • 1bigmess your post has really cheared me up (sorry i know you've just been made bankrupt) but i have my hearing next tuesday and i so hope it passes as quickly and smoothly as yours seems to have. Good look for your chat with the OR, please keep us posted as to how things go :)
  • Bet you're pleased that's over with and good news about your address not being published - I can completely see why.

Guess you will sleep well tonight!

Best of luck for a far less stressful future.

  • Thanks for all of your support and for those questioning why I should be treated differently because of my old job, here are the reasons....

I worked on a murder case. The offenders were all part of an organised criminal gangs and I'm not talking about teenage gangs with knives - that is bad enough but this was worse. There were threats made at the time that the officers involved ans their families would pay and we all had a degree of protection for a while. If my address had been published my family would be at huge risk.

With regards the private investigation job, again I'm not referring to upsetting people in a petty way. I was involved with fraud investigations and people obviously don't like it when they are caught out.

I'm sorry that people feel I have preferential treatment that I don't deserve, but hey of you were in my position would you not try and protect your family????

Again thanks to all of those that have sent their best wishes and for those facing it soon, good luck and trust me, it's fine....
  • I for one have no judgement at all 1BM, am glad you were able to sort it out. The financial strain is bad enough without all that extra worry - well done for getting through it.
    Good luck for the future.
