I am not planning on taking out another monthly contract. I was just enquiring as to whether or not I would be charged twice or if the Carphone Warehouse and o2 talk to each other so to speak and o2 would know I had upgraded by buying the new phone from TCW or there was an option to tell them that when you activate it or whatever. As I cannot upgrade by buying from TCW I will go into my local store tomorrow and upgrade in person. I wouldn't have bothered going if I needn't had done but as I do then I will. Problemo solved.0

I think I've got fully what you mean now, you wanted to get the 3G as a handset only (no contract) to use with your existing contract?
If so then no you can't do that, simply because until the PAYG Ihone comes out it is a contract only phone regardless of where you get it.

The main reason I wanted to buy it from the Carphone Warehouse website as opposed to going to the shop was so I could benefit from the 3500 odd points I would get from Mutual Points cashback site. (You get 4500 by using o2 but you can't get the phone from their website at the moment). Getting 3500 points would mean I could redeem £40 as I already have nearly 3000 points.0
